This act removes the requirement for non-smoking sections on private property. However it mainatins the provision that government buildings be smokefree. This is because, in the context of owning property rights, the government has the right to set the policy on its own property and there is such thing as legitimate government ownership of property if it is part of the provision of protection of individual rights.
