Bill: Rights of the Accused

Details

Submitted by[?]: AM Populist Social Democrats

Status[?]: passed

Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: January 2367

Description[?]:

Whereas, Everyone should recognize that not everyone accused of a crime is guilty, and

Whereas, It is a crime in itself if someone-- of middle class must bankrupt himself to defend himself against a crime he did not commit,

We hereby propose that all defendants be offered legal representation paid for by the state. This will be very basic legal representation, public defender level, and in many cases well off defendants will choose to hire more expensive counsel.

However, we believe that the option to defend oneself without great expenditure of money should be available to all, and propose that its cost shall be deducted from the defendant's assets if the defendant is not poor and is proven guilty, but that it shall remain free if the defendant is acquitted.

MessageNote the language that if the defendant is convicted assets are seized to cover the cost (if he isn't poor and thus has nearly no assets). The purpose it to protect the wrongly accused from financial ruin.
