MessageFor the sake of those not here when we made this argument before, patents should never be used to protect software and the like. The way to protect software is through copyright law.

What a software patent does is make it illegal for anyone to make *different* software that does pretty much the same thing. (OOC: If the USA had software patents, we couldn't have Windows-- regardless of what you think of it-- as the "similar look and feel" lawsuit to block Windows would have succeeded; if we had it now, Microsoft could use it against the Mac and Linux Windows emulators).

Software copyrights are enough to prevent people from "stealing" innovations and using others' software as their own. Make it patentable, and then people cannot offer choices.
