Bill: The Self-Defence Act

Details

Submitted by[?]: Aldegar Freedom Party

Status[?]: passed

Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: July 2384

Description[?]:

The True Conservative Party believes firmly in the fundamental right of every human being to protect himself, his property, and his family, from harm.
Therefore, the TCP proposes a new type of legislation:
- First of all, the TCP defines the term 'private property' as any home, building, office, or vehicle owned privately by a person.

1) If any person trespasses on a man's private property without the owner's consent, and starts destroying or harming the property in any way in an act of violence, the owner may take this matter into his own hands and use any force nessicary to stop the criminal, including lethal force and the use of firearms. The owner will be given civil immunity.

2) If any person trespasses on a man's private property and threatens the well-being of the owner or any of his family members or loved ones, the owner may use any force nessicary to stop the criminal, including lethal force and the use of firearms. The owner will be given civil immunity.

3) If any person trespasses on a man's private property with the intent to steal from him, the owner may use any force nessicary to stop the criminal, including lethal force and the use of firearms. The owner will be given civil immunity.

4) If any person threatens a man's well-being, regardless of the surroundings, the victim may use any force nessicary to stop the criminal, including lethal force and the use of firearms. The victim will be given civil immunity. Any witness to the unlawful act may also assist in stopping the criminal by using any force nessicary to stop him. The assistant to this self-defence will also be given civil immunity.

This bill ensures that every person can adequately defend himself in his home, car, office, or even in the street, without being victimized by unjust laws restricting him from protecting himself and his family from harm. Such laws have proven completely inadequate in the past, in cases where robbers trespassing on other people's private property have sued or incriminated the owner for using any force whatsoever against the criminal. This bill will put an end to this injustice. The TCP believes every person should have the fundamental and inexcusable right to defend himself, his property, and his family from harm, and that any assault or fatal violence that ensues should be irrelevant, as the user of self-defence should be protected by the law and given civil immunity.

MessageWe agree. We can't impede upon a person's fundamental right to defend him or herself.

MessageWhy exactly have the S.C.A.F.R. and GP voted against this proposal? Are they against a person's right to defend him or herself?

MessageThis really goes too far. Under this law, a man could legally kill someone who breaks into his car to steal the radio. We're not against the right to defend oneself, but there must be more rationale for defense than that.
