Message | We can see this point but feel that with the owner first setting the price, the result would be that the government would be less likely to claim property if it can be avoided. |

Message | On the other hand, if people want to resist the eminent domain claim, they can immediately ask a ridiculous price and then sit back as the government's suit finds its way through the courts. Including appeals, how many years will that take? And all that time the development project is waiting to begin. A neutral body is a fair balance between protecting individuals from government and allowing the government to proceed with its projects in a timely fashion. |

A neutral body will, by definition, have no ties to either side, while it's all too possible that development planners for the government might choose to buy out their friends for absurd prices and pass that little gift along to the tax payers. A neutral body is a far better defense against pork than having the victim name their price. |
