We feel eminent domain is justified, only when there is a pressing public task, or need, and only as a tool of last resort. To make the unfortunate experience as fair as possible to victims, we propose the following:

> A "pressing public task" can consist only of the following:

a) Repairs/Upgradation of existing public infrastructure.
b) Construction of new infrastructure/ adding to existing facilities when there is no other equally cost-effective option.
c) To facilitate relief and counter threats in emergencies, such as fires, landslides and eathquakes. In such situations firefighters may demolish homes, remove brush or otherwise manipulate private property to check the spread of fires or other disasters. Relief workers may compel residents to provide access to water or shelter for escaping citizens.


However, these are and will remain options of last resort. Victims will have full recourse to the law and their rights will be maintained at all times.

MessageWe would like to, but what about emergencies, or building infrastructure? These are govt tasks, which the govt may not be able to do without some eminent domain? It might make more sense to pay people to relocate rather than build around them...
