Bill: FPA 7-18 Right to Council

Details

Submitted by[?]: Teleurstelling Party

Status[?]: defeated

Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: June 2419

Description[?]:

In a functional Democracy and Free Society the Right to Council is fundamental.

With immense structure and wholly verbose law set the average citizen can not be expected to be capable of mounting a reasonable and adequate defense in the face competent prosecuting office of the locality or state.

As an essential right to have adequate defense our defendants have the legal right to place on retainer a legal advocate.

For those defendants who are not able and can not afford to retain the services of an advocate the State should, in providing equal protection provide for the defense of those people who can provide none for themselves.

MessageWhy should defendant the "low incomes" get special treatment? Should all men not be equal before the law? Either pay for everyone's defence or no-one's at all - nothing else could be considered equal or fair.

MessageWe agree with the BCD. However, we'll take any improvement over the current policy.

OOC: Did my proposal for legal aid not pass?

MessageOOC: Not according to the list of choices. I thought it did though which is strange..but when i checked it was set to not helping anyone.

IC:

This would ensure equality under the Law.

One man who can afford council is free to retain it, a man who cannot afford it is not free to retain it.

Hence only aiding the impoverished makes him equal to those who are not.

However this doesnt exclude one from claiming the right to a public defender...if some one of your stature would be so inclined to take charity. I do also note you voted affirmative to give millions away to foreign nations on a whim with no hope of return but raise a question at ensuring equal defense for our own citizens?

I am strongly questioning the loyalty of many members of this council to the electorate.

MessageOOC: Apparently, it has.

IC: It seems obvious that the Falls Party should actually review our voting record. As for the money given away, generally, charity doesn't give a return. It's given out of the goodness of your heart to those that most need it.

MessageThis legislatin stands to REMOVE the right to council from all but those on "low incomes". The bill's title and description are clearly designed to deceive.

MessageOOC: I think we've got a little confusion here with Bills on the same topc being put to the vote around the same time.

MessageQuite. Just to stress to the ANSP and Falls - this is what you are voting for:

Current: Legal representation for defendants in criminal trials is paid for by the state.

Proposed: Legal representation for defendants in criminal trials is paid for by the state for defendants with low incomes.
