Messageno, a gate does not permit racial discrimination, rather it permits a community to prevent unauthorized traffic. Thus if a community wanted to keep out a ice cream truck or through traffic, they could set up a gate. Similiarly this allows kids to be a bit safer playing outside, using the streets for ball play etc.
Racial as well as other forms of discrimination should not be permitted by law. Outlawing gated communities is not an effective method of targeting this sort of behavior.

MessageOutlawing gated communites does, however, prevent de facto discrimination that, and let's be frank, we all know is going to happen eventually. If people want to keep ice cream trucks and traffic off their roads, let them build a private road and be done with it. A gate and wall isn't just about keeping out traffic, it's about keeping out the unwanted people.

MessageA gated community is just extending the model of a house to the next level. Residents and their guests are permitted in the community, the same as the owners and their guests are the only ones permitted in a home. Does the LevP suggest that our citizens adopt an open door policy to their own houses? Would our distinguished collegue like to go home tonight to find 20 unknown "guests" moved into his home?
We should not cloud the issue with cries of discrimination or racial bais. We should not permit any community to discriminate in regards to these matters, but we should permit a community to close their door to unwanted vehicles, salesmen, or foot traffic.
