We feel that the nation of Trigunia, knowing the threats that the world poses, should have and operate a intelligence agency 1. there must be a clear division between the executive and the intelligence community (i.e., the government cannot use the secret service to spy on members of the opposition). There should also be no circumstances where the intelligence community is in a position where it can become politicised (OOC: as with the JIC in the British 'dodgy dossier' debacle). 2. For any domestic surveillance of Trigunian nationals, a judge should be obliged to approve any intelligence invasion where an individual has a reasonable expectation of privacy (i.e., the secret service can film people out in public without restriction, but would need to get specific judicial approval for a home wiretap). Such judicial approval can be obtained in camera but with the stipulation that it go on public record after a set term of 15 years. 3. The secret service cannot compel individuals or corporations to act in any way not required of them by published laws (i.e., has no special right to require disclosure of documents or records by individuals about themselves or others - so the service has no right to, say, ISP logs; similarly the service may not demand that, say, ISPs maintain recording or surveillance equipment on their private communications fibres for the benefit of the secret service). 4. Message | We have no objections in principle, but naturally we would require strong safeguards. Message | We agree that any country needs at least a basic intelligence agency to protect itself from upcoming dangers and to keep itself informed. We also agree with most of the Liberty Party's safeguards, but also feel that given the current bill they are mostly unnecessary, as the intelligence service is mainly for spying on other countries, and so do not apply. However, if the intelligence community were ever expanded beyond this, the Liberty Party's suggestions are an absolute must. |
