Bill: The Trial of Fiddle Casrolle

Details

Submitted by[?]: Enlightened Cosmic Brotherhood

Status[?]: defeated

Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: April 2480

Description[?]:

On December 26th, 2477 Fiddle Casrolle and a band of 82 men launched an attack on an IngSoc controlled barracks deep in the woods of Agundi. 70 of the 82 were killed, 9 retreated, and 3 were captured. Fiddle Casrolle, his brother Raoul, and Ernest Govarra, also know as "Hey Dude", are these three men.

Prosecutors from the IngSoc party have proposed the three be imprisoned for 12 years on counts of treason, attempted murder, theft, terrorism, speaking out against the government, wearing non-IngSoc issued military garb, and advocating armed rebellion.

Judge Judith Bitchmonstien has proposed, in a radical change from Al'Badarian legal precedings, to allow these three men's fates to be determined by the people. This, by extention, means the current parties. Deeming the attack to be "Clearly violent and militaristic with the intent to murder; yet, holding certain admirable qualities to it's bravery and ambition in overthrowing the unpopular military party which has recently gained a majority of seats. This is an issue that is best left to the people to decide".

Fiddle, upon being called to testify, issued a 4 hour speech detesting the IngSoc's rule. Here is a small sample:
"I am going to make only one request of this court; I trust it will be granted as a compensation for the many abuses and outrages the accused has had to tolerate without protection of the law. I ask that my right to express myself be respected without restraint. Otherwise, even the merest semblance of justice cannot be maintained, and the final episode of this trial would be, more than all the others, one of ignominy and cowardice. In what country is the Honorable Prosecutor living? Who has told him that we have sought to bring about an uprising against the Constitutional Powers of the State? Two things are self-evident. First of all, the dictatorship that oppresses the nation is not a constitutional power, but an unconstitutional one: it was established against the Constitution, over the head of the Constitution, violating the legitimate Constitution of the Republic. The legitimate Constitution is that which emanates directly from a sovereign people. I shall demonstrate this point fully later on, notwithstanding all the subterfuges contrived by cowards and traitors to justify the unjustifiable. Secondly, the article refers to Powers, in the plural, as in the case of a republic governed by a Legislative Power, an Executive Power, and a Judicial Power which balance and counterbalance one another. We have fomented a rebellion against one single power, an illegal one, which has usurped and merged into a single whole both the Legislative and Executive Powers of the nation, and so has destroyed the entire system. This is illegal not only in the legal sense, but in the social. These people have taken from us what we have fought so hard to preserve. In the faces of imperialists, of corporations, of tyrants and Kings Al'Badara pressed forward, trying to preserve her rights and freedoms. It is true, I was a member of the now outlawed Democracy Now! movement, and I was an idealist. I grew sick at seeing that all our best intentions were cast aside and ignored. The betterment of the people was clouded with doublethink and fast talk. Yet now, the time for diplomacy is over. We launched our attack, the first step in our revolution, to show the people we are united for their cause. For it is not the peoples cause to support the government, the fascists, the paramilitary powers that have stolen their rights, their liberties, their freedoms from under them. We do not believe we are the speakers of the people. We are but the pawns of the people. The Peoples Preservation Front was a terrorist group and should be forgotten. Adam J. Susan was a fascist himself, and his nervous breakdown following the failure of National Preservation Act 420 shows his weakness. Our new movement is one of change! One of freedom! One of hope! The December 26th movement holds no ties to the PPF! We hold no members from the PPF in our ranks, and only the most devoted and untainted Democracy Now! members are allowed in our ranks. We are for the people! We are for freedom! We are for revolution!"

*Fiddle walks to jury and seems to look all of them in the eyes*

"I know that imprisonment will be harder for me than it has ever been for anyone, filled with cowardly threats and hideous cruelty. But I do not fear prison, as I do not fear the fury of the miserable tyrant who took the lives of 70 of my comrades. Condemn me. It does not matter. History will absolve me."

VOTE:
Yes- Condemn the 3 men to 12 years imprisonment.
No- Absolve the 3 men of all charges.

MessageGodwin rose from his seat and took the podium. The air of fear that filled the room was like nothing the members had felt before. Godwin seemed to fill the room with a sea of cold water, one felt as though one was drowning. The deep breaths comming from all conners of the room. Monstrous, thought Fali, that man was Monstrous, yet Fali felt that never in a thousand years could he disobey this man. He remembered when Godwin had recruited him, when the monstrous man had looked straight into his soul........
"So" Godwin stated, the world seemed to shack "Fiddle Casrolle? What do I think of him? A idiot, that's what. First off, not only does he use violent terrorist methods to harm and intimated the people. He does so against the non-existent "IngSoc's rule"! I have news for you Fiddle, we have not yet come to power!
The Chairmen's office is currently held by the Union of Progressive Ulama! Any "Revolution" your planning would be against the Union of Progressive Ulama, and be undermining the goverment of the Union of Progressive Ulama!"
"This attack on a barracks of the professional army, whose ministry is currently under the control of the Peoples Communist party, simply because the army respects authority. Is a sign of how dangerous our nation has become under the Union of Progressive Ulama! Under IngSoc no such blind attacks on the troops of our nation would be tolerated, but alias, we are not in power. Though we may seem to be from the perspective of some post-anarch drugged up youths who try to overrun a military complex of THIS NATIONS ARMY!!!"
The room exploded with cheers, the members fear lifted from them as they hysterically cheered Godwin. They didn't care if they agreed or not, just to end the fear.

MessageConsidering that Mr. Cassrolle got elected, we assume that all charges have been dropped, although the AAP does not support government immunity. This is not saying that we condemn Mr. Cassrolle's actions OR consequences but do support in a full pardon (upon being found guilty) or a dropping of all charges against him.

OOC: If you did allow this to go back into voting, and he was found guilty, would there be an impeachment against him?

MessageOOC: I'm not sure? I wouldn't think so, as the government is currently under the control of a new party. It would all depend on if the SWSL wants it to go forward or not.

MessageWell, if this bill passes then the president will be impeached and new elections called but the IRL's circumstantial evidence and a court case that is too prejudiced, we see nothing wrong (yet) with the current administation and will side with a vote of not guilty although he isn't too innocent in the crime.

Will this be a coup d'etat? No, the IRL does not have a majority of votes in either for presidency or in parliament and albeit there is a minor level of civil war in Gharki, the IRL would be stupid and suicidal to attempt a civil war when their popularity waned considerably at the last election.
