| This bill aims to redress problems with lack of organs in the Hobrazian health system. Section 1; Donations. The law will reintroduce the following: People will have assumed to have given consent to have their organs donated People may opt out at any time and this data will be stored on their ID card and/or a separate card to enable their donation statues to be easily found Organ donation would be opt in for children so as to protect their interests An organ screening programme will also be introduced to prevent the transmission of diseases from the donor to the recipient. This bill will come into effect 1 year from the date of it passing. That period will be used to advertise the new system and people will be allowed to opt out at any time during it. Section 2; Treatment. Patients receiving a donated organ have the ability to consent or not consent to treatment so long as they can be proved medically "competent". Medical competence (for patients) is defined as: - Patient understands the need for treatment; - Patient understands the risks of treatment (or lack thereof); - Patient is deemed "mentally stable" and is capable of making decisions for themselves. Should any of the above be brought into suspect then the patient may be brought under the supervision of medical professionals to decide whether they can be deemed competent or not and a decision made on treatment. In regard children, they are deemed as medically incompetent until the age of 18 and cannot refuse treatment. Parent(s)/Guardians may refuse treatment for children for religious reasons, so long as they are deemed of medical competence, but may not force children to not receive treatment if the life of the child is at risk. Non-acceptance of treatment for religious reasons is acceptable so long as medical competence has been confirmed. |

| Message | We should actually discuss the rules for receivers. Should it be mandatory, can sick people opt out on receiving organs, what about for religious reasons and people in coma, not to mention children. Just a thought. |
