The policy of permitting the purported "victims" of eminent domain to be the sole arbiters of "just compensation" effectively nullifies the policy of "eminent domain," as the libertarians well know. This is so because landowners who do not want to surrender their land can simply set the "just compensation" for it at such an astronomically high rate that the government will refuse to exercise its eminent domain power.

When the government exercises its eminent domain power, it has determined that the taking of a tract of land is necessary to effectuate some public good. A stretch of road needs to be laid, a park needs to be built, etc. But we do respect the rights of the landowner, and so we require that he be compensated "justly."

The policy we propose empowers landowners to set the price of their land in the first instance. If the price they propose is unreasonable, the government bears the cost of appealing it to the courts. Courts will give significant latitude to landowners in setting their prices, but absurdly high prices transparently designed to prevent the effectuation of the public good will be judicially reduced to reasonable levels.
