Description[?]:

The last time changes were proposed to smoking, only a single vote carried the day. The Vanuku Sinatranoan Party still harbours concerns that not everyone's rights and freedoms are being defended with current legislation.

The only places smoking is to be permitted is:

a) Outdoor areas.
As well as the outdoor environment (parks, etc.), outdoor areas (such as courtyards, open-air malls) are defined as any area with less than 25% roof covering, or at least 33% wall space open to the outdoor environment. Should a temporary covering (such as marquee tent or plastic awning) be put in place for a period of time that removes the area's eligibity for smoking, then no smoking may occur until the temporary covering is removed.

b) Private homes.
The private residence of any citizen of Vanuku is exempt. The rights of our citizens to partake in any legal activity in the privacy of their own homes is sacrosanct, and must be preserved.

c) Private clubs.
This does not mean public bars, casinos, or any other place of social activity that would normally share a link with smoking. A private club is an organisation that expects the vast majority of its members to smoke whilst meeting (for example, a smoking club). Ideally, such a club would also provide a separate enclosed room for non-smokers, to better cater to the needs of all patrons. Similarly, public bars, casinos, etc., may nominate an enclosed indoor space to be their private club room, also to better cater to the needs of all their patrons. With the venues seeking a private club room, smoking still cannot take place in any indoor area where meals are being served.
All venues and clubs wishing for partial or total exception to smoking bans must apply to the Ministry of Health with supporting evidence of their eligibility. The necessary forms can be downloaded from the Ministry's website, or mailed if requested by telephone.

Strict fines will be applied to offenders, both venues and individuals.

In this way, the rights of people to enjoy social activity without damaging their health is balanced with the rights of people to smoke in the public arena.
