Description[?]:

Since there is no way for impeachment allowed in the Constitution, this amendment will serve the purpose of explaining the process.

The following procedures must be taken in an impeachment process:

1- Articles of impeachment must be introduced in Parliament citing the reasons for the impeachment.

2- Parliament will vote on the Artciles of impeachment to allow debate on them. Only a majority of votes present in Parliament is needed.

3- A debate of the impeachment shall be conducted chaired by the Chief Justice, if a Supreme Court exists but they shall not play any role in the decision, that is a sole power given to Parliament members.

4- During this debate phase, all arguments must be presented including additions to the charges if agreed to by a majority of votes present in Parliament in case objection occurs. if objection does not occur, the motion will be introduced without the need of a vote.

5- The government officials being impeached has the right to defend himself/herself from all charges but may not play a role in the decision making process, that is a sole power given to Parliament members.

6- After all arguments have been heard a final vote on the removal of the government official shall take place. A fifty-nine percent majority of votes in Parliament is needed for removal of the govrnment official. If this threshold is not achived, the government official will be exonerated of all charges.

7- Upon finding of new evidence, the government official may be impeached again under the same charges and the process will follow steps one through six.

As a Constitutional Amendment, this bill requires two-thirds of Parliament to vote in favor.

MessageBefore anyone asks. In article 7, 59% is the middle number between 67% (2/3) and 50%. I did as a compromise because I think 2/3 is too much.

MessageIt seems too much for me. Our country is based on the "majority wins" process. But I understand that some parties may like 2/3, that's why I made it halfway throught both possibilities. It is a compromise, not everyone is going to get all they want. I hope everyone understands.

Message59% is close to two-thirds. 9% away from 50% but 8% away from 67%. It isn't easy to get 59% of the votes in Parliament but also don't want to make it impossible to accomplish. 59% is 88 or 89 votes, that's a lot.

MessageWell we do got one thing regarding the impeachment process in our law. The Chief Justice will preside over the impeachment as of the current law.

I dont like including the PM into the impeachment process, The judicial branch should preside over this while the legislative branch should decide. The executive branch should not be a part of this

The Prime Minister, as Head of Government, should have the right to co-chair the hearing. Remember, they cannot speak in the hearing (unless asked to testify if he/she is involved). Serving as chair is more of symbolic than having any influence whatsoever.

I dont disagree with the Chief Justice chairing the impeachment, but I disagree with including someone from the executive branch as co-chair
