In the interests of public safety the Police are empowered to monitor any group operating in a suspicious manner or that is deemed to be a danger to either themselves or those around them . Guidelines will be put in place for the Police as to what equates a breach of the peace or a danger to public safety. This law does not empower the Police to disband any groups without provocation, or without probable cause, nor does it allow for intervention within an organised assembly of persons, be the gathering of a political or social nature, without aforementioned cause. However if it is believed that said group could become violent or breach the peace in some way so as to cause public disorder, the Police are empowered to disband said group in a peaceful manner. Should peaceful means be unsuccessful than the Police are entitled to use whatever means necessary, barring lethal force, in order to subdue those that may become a danger to either themselves or the public. This law may not be used, either politically or by the Police, to forcibly place restictions on peoples right to gather, rather it only allows the Police to disperse groups should they become a point of public disorder. *A breach of the peace is classified as: A person who recklessly, knowingly, or intentionally: (1) engages in fighting or in tumultuous conduct; (2) makes unreasonable noise between the hours of 11pm and 6am and continues to do so after being asked to stop; or (3) disrupts a lawful assembly of persons. *commits disorderly conduct. |
