Message | Ok, but in my country there's a difference between divorce with or without blame. In case of adultery, the one who's catched in adultery is considered as having made an error and gets the blame. He/she can be put at a disadvantage when the division of the joint proporty or the visiting rights are decided. When one of the partners decide to divorce without blaming the other for having done something wrong, it's more probably that visiting rights etc are more fairly spread. When you want to keep this distinction; is this possible without making adultery illegal? OCC: sorry for putting my question that lengthy, english isn't still my favourite language :p |

Message | To answer BF's question, it is indeed possible, and would not require making adultery a criminal offense. Simply change the divorce law, or the judicial guidelines, to emphasize that the wronged party in an adultery should be compensated. Of course, our judges are sensible people and in most divorce cases, a partner who can prove adultery already has a greater proportion of property awarded than otherwise. |
