Apart from the ethical dimensions previous laws already grant personhood status to whales and make
the killing of a whale the same as the killing of a person, murder.

MessageWhales, Dolphins (with the exception of Orca's) and Elephants are given personhood, we have a tiered system for all other animals, right below the top tier, which includes the above as well as Humans, is the sub-sentient level, meaning animals that display some level of sentience but not can not be considered full sentient beings, this category includes things like Humboldt Squid. Their are two levels below that, with various animals in each category based on the level of sentience it has shown.


As a side note to be fully sentient a species must show three traits;
1. Complex thought and memory. (Emotions are a form of complex though but not a requirement.)
2. The ability to communicate with others of its species beyond simple primitive concepts.
3. And last, and perhaps the most important, self-awareness.

The animals (Humans are animals as well) with sentient rights fit the above three categories, hence why their are so few.

MessageThat should be changed in the future then. Perhaps only some Primates can be considered to be self-aware, and Dolphins, but Whales and Elephants, no. We will work on a proposal to remove them from the list.

MessageWe are against whaling of course, but giving someone the same sentence for killing a whale than killing a human being is unacceptable.

MessageElephants belong on the list before most primates since they're more developed.
Elephants have long term memory, complex though, complex communications are self-aware, and actually have culture.

Whales are similar, they show complex thought, self-awareness and complex language, in fact from studies we actually know whales have accents based on where they live much like Humans do.

Humans and Bonobo's are the only great apes in the top tier for the simple reason that while the great apes may be our closes living relatives, they also don't fit all three requirements, so they're part of the second tier.


On a final note, removing any animal form the top tier list requires a constitutional majority as it strips rights.
