The 'Rutanian Heritage Party' believes that the death penalty is an appropriate punishment for capital offences, as it is the only retributive punishment commensurate to crimes of such a severe nature. We do not believe that the criminal justice system can be used as a means to 'rehabilitate' offenders, as most, particularly those who commit serious crimes, simply cannot be rehabilitated, and there is no proof that such a strategy works to any great effect. Similarly, there is little evidence to suggest that deterrence is an effective justification for punishment. The 'Rutanian Heritage Party' believes, therefore, that the criminal justice system can only effectively be used to punish offenders in a way that adequately compensates their victims and the people at large, as well as removing them from society, so that they may no longer pose a risk to others. Capital punishment is an appropriate form of punishment in achieving this. Consistent with federalism and a respect for state's rights and autonomy, the 'Rutanian Heritage Party' believe that the issue of the death penalty should be devolved to local governments, due to its controversial nature, rather than being mandated at the federal level. Under this legislation, the death penalty may legally be applied to the following crimes in any state of Rutania: a) Murder. b) Rape. c) Child molestation or any sexual abuse of a child. d) Terrorism or plans to commit terrorism. Each state may choose to apply the death penalty to all or any of the aforementioned crimes. |
