Considering our nation’s stance on Capital punishment (death penalty) the DLU note with concern that our extradition policy is incongruent with this stance and we therefore propose to chance this anomaly. We thus propose the following: |

Old value:: The law does not limit the power of the government to pursue extradition treaties.
Current: The law bars the government from extraditing anyone who is a citizen of the state.
Proposed: Extradition to nations with capital punishment is not allowed, unless there are assurances that the death penalty will not be imposed.

Message | The LP must respectfully disagree. While our own policies reflect a strong stance against the death penalty, preventing extradition to all countries with capital punishment denies those nations' autonomy and undemocratically forces our own values upon wholly separate and independent peoples. We understand the concern that certain countries may have corrupt governments that are beyond the rule of law. In these countries, a fair trial is nearly impossible, therefore increasing the likelihood an innocent individual will be executed. However, we likewise do not approve of United Jakania becoming a haven for murders and terrorists. That is why we favor unrestricted power to pursue extradition treaties, which then allows the Minister of Foreign Affairs to judge each country on a case-to-case basis, denying extradition to some countries (where, for example, fair trial cannot be guaranteed) and allowing it to others. |

Message | Firstly the DLU thanks the NP, LP and JCP for their support. Does the JLSP have any comments before we move the bill to vote? With regard to the comments from the honourable JLP we must respectfully disagree with their position. Either our government disagrees with the death penalty or it does not. We have chosen the position against, which in our humble opinion is the correct course of action. By that decision we are not just making a decision on behalf of our own peoples, but also sending a larger message to the international community in that Jakania feels the death penalty is wrong. To then extradite individuals to nations who have the death penalty is a blatant disregard of our principals and frankly if we can’t stand by our principals we feel that diminishes our position in front of the international community. Furthermore considering the foreign minister currently makes this decision we feel it is inappropriate for him/her to make a decision, which may go against his or her own conscience. In this way the matter is resolved and State’s position is quite clear. The Foreign Minister can still of course extradite whomever he or she wishes providing the requesting nation will give clear and unequivocal assurances that the accused will not be executed if found guilty. |
