This Act will return some responsibility to the trade union movement. This Act also enshrines in law the right of a fired worker to seek compensation in court from his employer for "unlawful dismissal". Any compensation granted would be entirely up to the courts to decide. |

Current: Employers can fire workers who are deemed to have gone on strike without reasonable reasons.
Proposed: Employers can fire workers who are deemed to have gone on strike without reasonable reasons.
Article 2
Proposal[?] to change Secondary strike action.
Old value:: Any trade union can go on a sympathy strike in support of other striking workers.
Current: Secondary strike action is illegal. Workers and unions can only go on strike for their own pay and conditions.
Proposed: Only closely related trade unions can walk out on a sympathy strike in support of other striking workers.

Message | Rt Hon Duchess Thompson MP: Mr Speaker, the House will acknowledge that the CLP has compromised on this issue. It is important that some change is made to the status quo to ensure that business can operate with some certainty. Mr Speaker, we accept, more than other parties would have the people believe, that workers have the right to strike. Indeed, we regard it as a basic civil liberty. However, there must be some control on this Mr Speaker, to ensure that the rights of workers are balanced with the rights of the population at large to receive goods and services. Mr Speaker, the current situation spreads uncertainty across the land, and some unions seem to be suggesting strikes almost continuously! We believe that this would be a step in the right direction, ensuring that strike action is taken only when it has something to do with their own work. Mr Speaker, it would also allow the employer to have some autonomy back, being able to make decisions. This Act will also enshrine in law the right of an employee to seek compensation for unlawful dismissal. That is a first, Mr Speaker, and something we are sure that the other parties will be keen to support. |
