PREAMBLE: Recognizing that unexpected events - man-made or natural - may threaten the stability and security of the Commonwealth of Sekowo and her inhabitants, this act seeks to establish procedures and guidelines regarding the handling of various possible emergency situations.

ARTICLE I: NATURE OF EMERGENCIES

1. A "public welfare emergency" shall be defined as an emergency that poses an imminent threat to the life and safety of a significant population, causes severe disruptions to the flow of essential goods and services, or critically threatens the stability of an area.
1.1. Examples of public welfare emergencies include - but are not necessarily limited to - floods, droughts, earthquakes, hurricanes, storms, pandemics, and other accidents.
2. A "public order emergency" shall be defined as an emergency caused by unlawful and violent acts aimed at overthrowing the constitutional government of Sekowo in order to achieve political or ideological objectives, that undermines the safety of the Sekowan people and the stability of the Commonwealth.
2.1. Examples of public order emergencies include - but are not necessarily limited to - mass espionage and/or sabotage by foreign governments, armed rebellions, and terrorist acts.
3. A "war emergency" shall be defined as an emergency involving armed conflicts - current or imminent - that directly undermines the safety of the Sekowan people and the stability of the Commonwealth.

ARTICLE II: DECLARATION OF AN EMERGENCY

1. With consent from the Premier, the President may issue a declaration of emergency.
2. Any declaration of emergency must cite specific examples of emergencies, the nature of said emergencies, and the effective duration of the declaration.
3. Any declaration of emergency may not be effective for more than two months, unless renewed by the government.
4. Any declaration of emergency must be approved by a majority in the National Assembly before coming into effect.
5. Any declaration of emergency must be accompanied by a cabinet proposal, reaffirming confidence in the government.

ARTICLE III: EMERGENCY RESPONSE

1. The responsibility of emergency response at the national level shall be charged with the Sekowan Emergency Response Authority (SERA), which shall be placed under the jurisdiction of the Ministry of Internal Affairs.
2. Employees of SERA are to be appointed in a manner similar to other positions within the national civil service.
3. SERA shall be responsible for coordinating the various emergency response units (across all levels of administration) in Sekowo, as well as the Sekowan Armed Forces if necessary.

ARTICLE IV: LIMITATION ON CIVIL LIBERTIES

1. Any limitation on civil liberties must be stated in the declaration of emergency.
2. Only civil liberties cited in sections 3 and 4 of this article may be limited in any emergency.
3. The national government may implement a partial or total curfew in some or all territories of Sekowo, if necessary to guarantee the safety of the public and the stability of the constitutional government.
3.1. The government must ensure that citizens still have access to all necessities of life while a curfew is in place.
4. The right to assemble may be curtailed partially or totally, if necessary to guarantee the safety of the public and the stability of the constitutional government.
