By letting the victim of eminent domain decide for themselves what they see as fair compensation, there is a greater chance of mutual agreement. Rather than receiving it from a court, this could help make the process smoother by invoking a sense of empowerment in whomever the gov't is dealing with. However, there must be limits as to what the victim will receive, and in those cases the gov't will have the opportunity to appeal to a court of law, which will rule whether or not the demands are resonable. |
