Bill: Supreme Court Justice Nominee: Class D1 [CHIEF JUSTICE] (June 2947 - June 2968)

Details

Submitted by[?]: Conservative Party of Solentia

Status[?]: passed

Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: July 2946

Description[?]:

In accordance with the soon to be passed Supreme Court of Solentia Act of 2943 (http://classic.particracy.net/viewbill.php?billid=292015), the Supreme President of Solentia, Helen Brown, is entitled to nominate three candidates to become Supreme Court Justices on June 2947, assuming confirmation by 50% + 1 votes in the Senate. The first nomination shall be for the D1 Class Justice, who shall become Chief Justice of the 1st Supreme Court of Solentia for 21 years.

It warrants reminding that D1 Justices SHALL not be Chief Justice in normal cases, A1 Justices shall be. However, this is the initial court and this was the procedure set forth in the Act.

BIO:

NAME: Alexander Davis
AGE: 58
EXPERIENCE:
----- Minister of Justice of Solentia (2942 - June 2947, if accepted as Chief Justice).
----- Constitutional Lawyer advising the CPS for 18 years.
----- Drafted the Supreme Court of Solentia Act of 2943.

COMMENTS: Davis is without question one of the most brilliant legal minds in Solentia today. He served as Minister of Justice under former Supreme President Harding since 2942, and is responsible for the drafting of the Supreme Court of Solentia Act of 2943. He is a known advocate of Supreme Presidential power, and , interestingly, although he is supported by the CPS, he is known to be significantly to the left of the party line on many matters. Mr. Davis has the complete confidence of Supreme President Brown.

The floor is open to questions from the Senators.

MessageAlthough the Utilitarian Party of Solentia has high regards for Mr. Davis, we are aware of his hard work and his energy invested in shaping the this Supreme Court of Solentia and its rules and procedures, and we therefore wonder if his nomination may not be seen as a conflict of interest. We consider that if he is effectively appointed to the post, he will be an excellent Chief Justice given the fact that he designed many of the guidelines of the court; however, it can also be objected that a civil servant accomplishing the remarkable feat of modelling a Supreme Court leaves many doubts if he is appointed as the first chief of what he designed. Could Mr. Davies please explain how this course of action doesn't constitute a conflict of interest?

MessageTo the Senator from the UPS,

I feel that, should I be appointed as the first Chief Justice of the Supreme Court, I will have no conflict of interest at all. It is true that at this moment I am Minister of Justice, but if I were to be accepted by the Senate I would resign that post and focus my efforts on the judiciary. Who better than I to set the first rules and procedures of the Court, and to set precedent, when it is I who wrote the document establishing the Court? My in and out knowledge of the law governing our Court will be invaluable and I believe that I will serve the Court and the nation honorably.

Minister of Justice Alexander Davis
