Introduction Explanation:
This Resolution would effectively revitalize and amend the existing Department of Peace in order to modernize the current system and allow it to function to its full potential.

Article I: Senate Findings

Section 1) The Senate finds that under the current system, the Department of Peace has fallen into disuse for years, with only one Minister of Peace holding the office in 500 years.

Section 2) The Senate finds that under the current system, the Department of Peace is not properly enforcing its mission which it is bound to do by law approved and made official by the Senate.

Section 3) The Senate finds that under the current system, the Department of Peace has mitigating factors and legal coding that no longer is acceptable to modern Solentian standards.

Section 4) The Senate finds that a new piece of legislation specifically addressing the Department of Peace is required in order to allow it to function effectively through amendments.

Article II: Definitions

Section 1) Senate Warden is also known interchangeably as the Head of Government of Solentia or simply Head of Government.

Section 2) Supreme President is also known interchangeably as the Head of Sate of Solentia or simply Head of State

Section 3) Senate is also known interchangeably as the legislature of Solentia or simply legislature.

Article III: Department Purpose

Section 1) The purpose of the revision and revitalization of the Department of Peace is to overhaul a system that may largely be considered broken. Despite the current existence of the Department of Peace, only one administration has utilized the Department.

Section 2) The current legislation does not accurately reflect the accepted standards for legislative approval the Senate upholds today. The existing law calls for a complete 100% Senate vote to override the Minister of Peace's war veto, something modern standards deem unreasonable.

Section 3) The current legislation will continue to be neglected despite holding weight of law and must be revamped in order to produce its full potential.

Article IV: Department Powers

Section 1) The Department of Peace is granted the power of war intervention in the case of the Senate, Minister of Defense, Minister of Foreign Affairs, Senate Warden, and Supreme President approving mobilization of the Solentian Military for conflict.
(S1, a) -------------- The Minister of Peace may issue a writ of intervention declaring a declaration of war void within 9 months of the original act by the aforementioned parties.
(S1, b) -------------- The Minister of Peace's writ of intervention may be overridden by the Senate with 2/3 of the vote, or 67% of the sitting Senate.

Section 2) The Department of Peace is granted the power to tackle poverty and alleviate social ills particularly prominent among Solentians. It shall work in conjunction with the Ministry of Health & Social Services in alleviating drug related issues, crime, and social rehabilitation. The Department shall also attempt to work as an advocate for democratic voting rights and governmental participation by sponsoring get-out-the-vote programs and systems that further encourage aforementioned activity.

Section 3) The Department of Peace is granted the power to work internationally to resolve crises and issues of human rights abuses in foreign nations. The Department of Peace must work with a mission directing its agenda that calls for a world of human rights, social justice, and peace to end conflict.

Section 4) The Department of Peace is expected to be consulted and take part in any debate regarding the event of the Federal Republic taking part in international conflict and war. The Supreme President, Senate Warden, Ministry of Defense, and Ministry of Foreign Affairs are expected to share vital information and classified security briefings with the Department of Peace.

Article V: Minister of Peace

Section 1) The Minister of Peace shall be the chief official given the responsibility of overseeing and directing the Department.

Section 2) The Minister of Peace shall be given the powers and duties that pertain to already existing Ministries in the cabinet, respective to his/her own department.

Section 3) The Minister of Peace shall have the final say and decision in Department matters.

Article VI: Office Succession

Section 1) The Minister of Peace shall be nominated and appointed by the Supreme President of the Federal Republic of Solentia. The Supreme President may nominate and appoint a candidate to replace the incumbent Minister of Peace two years before his term is over and if approved by the Senate, the candidate shall become the Minister of Peace upon the incumbent's term expiring.

Section 2) The Minister of Peace shall be considered, debated, and finally confirmed/rejected by the Senate. The Senate shall need 50% + 1 to confirm the candidate for Minister of Peace.

Section 3) The Minister of Peace shall serve a 20 year term that shall be no shorter nor longer than the amount named. In the case of the Minister resigning, dying, or retiring, the Supreme President and Senate are bound to replace the incumbent to ensure no vacancy.

Section 4) The Minister of Peace may be impeached by the Senate if it feels an absolute need to vacate the office and replace the incumbent with a new Minister. The Senate must partake in debate, publish a list of reasons as to why impeachment is necessitated, and vote with 2/3, or 67%, in favor of impeaching and removing the Minister. The debate must last at least a year and the list published within the timeframe.

Article VII: Appropriation of Funding

Section 1) The Department of Peace shall receive its operating budget from an appropriation of funds though the Ministry of Foreign Affair's allocated budget. The amount appropriated for the purpose of the operation of the Department of Peace shall be decided through a base percentage of 25%. This shall mandate that 25% of the Ministry of Foreign Affair's operating budget be granted to the Department of Peace.

Article VIII: Status

Section 1) Through passage of Senate Resolution 184: Department of Peace Revitalization Act, the Senate overrides Senate Resolution 23: Department of Peace Legalization Act (http://classic.particracy.net/viewbill.php?billid=135330).

Section 2) Through passage of Senate Resolution 184: Department of Peace Revitalization Act, the Senate hereby adopts the language within this resolution as the full force and weight of law and as binding.

Article IX: Rules

Section 1) This resolution requires 2/3 of the sitting Senate in order to attain passage and achieve status as law.

Section 2) This resolution is a binding piece of law and shall require a full 2/3 of the sitting Senate in order to repeal its status as law. This resolution, upon becoming law, will remain in place until a piece of legislation specifically addressing its existence overturns it.

MessageYour question is appreciated, Ms. Bryant.

The purpose of Article IV, Section 2 is for the nation to have an additional tool to cohesively attempt to resolve serious issues of drug related issues, community social ills, and turn around voter apathy. In order for Solentia to be a successful nation promoting the issue of peace it must first envelop qualities of peace. By attempting to rid the nation of some of its most serious issues, it must tackle what is wrong at home before it can undertake the same abroad. It would be hypocritical for the Department of Peace to preach a message and actively participate in a foreign nation something that another Ministry in Solentia itself fails to act on. Therefore, we feel with the additional presence of the Department of Peace and a record proven by the Department that it is committed to rectifying social issues in Solentia, it can ultimately fulfill its duty even more thoroughly and efficiently.

In addition, I thank the CPS for its initial support for this crucial revision of a long existing piece of legislation that has for too long been neglected.

MessageThe Utilitarian Party of Solentia is concerned with this bill. Although the idea is noble and kind, politics are neither noble nor kind.In the event of a foreign intervention we cannot rule out that the party controlling the office is a spy party. His ability to stop a quick response is a danger as long as he can block the war effort. He may as well delay a response for up to 8 months considering how lengthly the legislative process at times becomes.
The position is vicious and implies a limitation on the powers of several cabinet members. The Senate Warden chairs the cabinet and he is only respondent to the Senate, not to a single man who was named "Minister of Peace". Not even the Supreme President can fire nor block the Senate Warden without Senate approval. How can a single man do that?
On economic terms the Foreign Affairs Ministry is currently underfunded. It is true that Uwe Johannes has done an astonishing work on the Ministry without asking for more budget, but a 25% share going to a ministry with no real value to the Solentian nation is not reasonable. Furthermore, since the peace minister will be proposed by the Supreme President, it might as well happen that a totalitarian Supreme President with a totalitarian majority in the Senate approve of a peace minister with no true respect for human rights. This last situation would lead to the total politicization of a relevant issue. Human rights observers must at all times be neutral.
We hope the FIP does consider some of our views on this issue.

Message"To the Senator from the UPS:

The use of the Minister of Peace as a spy is unlikely in the opinion of my party; this is why the MoP must be nominated by the Supreme President and THEN approved by the Senate, just like the rest of the Cabinet. If the MoP is considered to be an intelligence weak point, then the Minister of Food and Agriculture is the same potential threat.

The minister shall be neutral as the Solentian Supreme Court Justices are neutral. This bill must be revised so as to allow for long-term tenures for the MoP, the CPS suggests 20 years. This way, the position will become much less political and much more geared toward the preservation of peace on Terra. The CPS also proposes that an impeachment process be included, if the Senate should find some flaw in the MoP's work, with perhaps a 2/3rds Senate vote removing him from office.

Obviously the Ministry of Foreign Affairs must receive a budget hike in order to absorb the costs of the creation of the Department of Peace.

In the event that some totalitarian party should gain the Supreme Presidency and a majority of the Senate, almost all of Solentia's reasonable commitments to human rights, peace, and government would be at stake. This possibility is no reason to discourage an attempt at maintaining peace on Terra while our government remains rational. In any case, if an impeachment capability is included, the reasonable minds of government may once again reinstate order when the tyranny has passed."

MessageIt is the firm view of the Left Radical Party that the advocacy of peace throughout Terra is and should principally be the function of the Solentian Foreign Ministry. We are sympathetic to the argument that the powers assigned to the Ministry of Peace would be more appropriately exercised by the Foreign Ministry.

We look unfavourably upon both the length of the appointment and the 2/3rds majority required for impeachment as we believe this could frustrate the legitimate will of sovereign governments in the future.

We will not support this resolution.
