By powers granted to the Supreme President in Article 5 of the Supreme Presidential Power Clarification Act 2786 (http://classic.particracy.net/viewbill.php?billid=257919), I, Supreme President Helen Brown, having realized that the position of Senate Warden of Solentia has been vacated by Claudius Jacobson of the Utilitarian Party when he succeeded former Supreme President Martin Astor, do hereby decree that the position of Senate Warden shall be filled by Mr. Jacobson again, or, lacking his consent, a similar representative of the UPS' choosing. This Senate Warden shall serve only until I leave office in 2954, or until a new cabinet is voted in by the standard means. This decree may only be nullified if 2/3rds of the Senate should vote in the negative. |

Message | Was the executive order needed at all? Supreme President resigned. Using Senate Resolution 70 [http://classic.particracy.net/viewbill.php?billid=195040] as our legal sustainment, there is really no reason to believe Senate Warden Claudius Jacobson is not currently holding the position of Senate Warden. The bill sets a precedent in cases where Supreme President is unable to rule because of health issues or death. This was not the case. Supreme President Astor simply resigned without even presenting the document or endorsing any other statement defending his decision. It does seem his resignation was not legal and the procedures were not followed. He didn't resign because of health issues and we could argue Senate Resolution 70 was not in place. If we do accept the legality of his resignation (which, by the way is hard to believe), Senate Resolution 70 states: "Following the death or disability of the Supreme President, the Senate Warden shall be temporarily elevated to the position of Supreme President. " Temporarily means that once the issue is solved, Senate Warden returns to his usual duties. He remains with the possibility of running for a second term; however, Senate Warden Claudius Jacobson did not even run for the office. Moreover, we wasn't provided with the usual regular powers of Supreme President. He was not given the legal opportunity of presenting his own cabinet. With all this in mind, the Utilitarian Party of Solentia reconsiders its original vote. Executive order is not in order and it is not even needed. Senate Warden Claudius Jacobson didn't resigned to his tenure as Senate Warden and the legality of Supreme President Astor's resignation is challenged. We therefore abstain on this unnecessary vote. We will defend the legal framework by all means. |
