Article 1.
Road Networks.

Sub-section 1; Infrastructure.

Sub-paragraph 1; Inner-Urban, Suburban and Rural Networks (designated 'B' roads).

Inner Urban and Suburban Road Networks are owned directly by the National Government under the auspices of the Ministry of Transport and Infrastructure (henceforth referred to as the Ministry). These networks are planned and constructed by the Ministry in direct partnership with Local Government.
Day-to-day maintenance, operation and construction of these networks will be carried out by Local Government. This maintenance can either be carried out "in house" via Local Government maintenance contractors or the Local Government can, should they wish, out source to Private Maintenance Contractors.

Sub-paragraph 2; Inter-Urban and Muliti Carriageway Primary Road Networks (designated 'A' Roads).

Inter-Urban and/or Multi Carriageway Primary Road Networks are owned directly by the Ministry. These networks are planned and constructed by the Ministry in direct partnership with Local Government(s).
Day-to-day maintenance and operation of these networks will be carried out by Local Government(s). Construction of these networks can only be agreed upon by complete agreement of both Local and National Government.
Day-to-day maintenance can either be carried out "in house" via Local Government maintenance contractors or the Local Government can, should they wish, out source to Private Maintenance Contractors.

Sub-paragraph 3; Long Distance Cross Constituency Multi Carriageway Primary Road Networks (designated 'M' Roads).

Long Distance Cross Constituency Road Networks are owned directly by the National Government under the auspices of the Ministry. These Networks are planned and constructed by the Ministry following National Transport guidelines and requirements in discussion with Local Government.
Day-to-day maintenance, operation and construction of these networks will be carried out by the National Government. This maintenance will be carried out by "in house" National Maintenance companies but can, should the need arise, sub-contract work to Local Government Maintenance Services.

Sub-section 2;
Road Based Public Transportation.

Road Based Public Transportation will consist of Three distinct sectors.
1: Local Bus Services (Including Park & Ride services).
2: Long distance Coach Services.
3: Local Taxi Cab Services.

Sub-paragraph 1; Local Bus Services (including Park & Ride).

Local Bus Services are owned and operated either via Local Government or sub-contracted Private Bus Companies, or a combination of the two.
In areas where Local Bus Services are owned by Local Government those services will be owned, operated and maintained by Local Government Bus Operating Companies. These companies will provide all Inner-Urban, Suburban and Rural Services throughout their operating sectors. Limited subsidies will be made available from National Government, via the Ministry, in assisting operations of services in those areas where limited income streams are available but where Local Government deems services will still be required for Public good.
In the instance that Local Governments sub-contract to Private Bus Companies, this can be achieved via one of five systems.
1. Complete de-regulation of Local Bus Operations. These Private Operators will operate without support from Local or National Government and will be forced to operate, own and maintain any and all vehicles.
2. Local Franchise Agreement to be agreed with either one or more Private Operators. Local Governments will allow Private Companies to operate services only within defined "Franchise remits" (to be agreed upon by Local Government(s) and the Ministry) and services within those franchises will be operated, owned and maintained by Private Companies for the term of the franchise.
3. Deregulation of Local Bus Operations with Local Government subsidy to encourage Private Companies to operate services in those areas where continued service provision is deemed to be required for the public good. Private Companies will be required to operate, own and maintain all vehicles and services.
4. Regulated Private Bus Operations operating alongside Publicly operated Local Bus Provider.
5. A combination of the above four systems as agreed upon by Local County Councils with a 2/3rds vote.

Sub-paragraph 2; Long Distance Coach Services.

Long distance Coach Services are owned and operated primarily by competing Private Coach Companies. These Companies can operate services between any and all large and small scale Urban and Rural areas depending upon need deemed by the Company. These Private companies receive no subsidy from the Government and are expected to operate on a for profit basis.
In order to guarantee fair trading and maintain standards within the industry, all Private Coach Services will come under the scrutiny of the Ministry. The Ministry reserves the right to levy fines and penalties against any company deemed to be breaching safety standards or operating irresponsibly.

Sub-paragraph 3; Local Taxi Cab Services.

Local Taxi Cab services are owned and operated by Private Taxi Cab Companies or Individuals.
In order to operate, Private Taxi Cab Companys or Individuals must first be licensed by the Local Government and will be expected to operate within terms of conduct agreed upon with the Local Authority.
All Taxi Cab drivers will be expected to take and pass any security and/or licensing requirements required by Local Governments before being allowed to operate Taxi Cabs for Public use.




Article 2.
Rail Networks.

Sub-section 1; Infrastructure.

Rail Infrastructure, including but not limited to;
- Track,
- Stations,
- Depots and Maintenance Facilities,
- Signalling,
will be owned and operated by Hobrazian Railways (HR). HR is a publicly owned Rail company operated by the Hobrazian Railways Board (HRB) under the auspices of the Ministry.
All maintenance of Track and Infrastructure will be carried out "In House" to help maintain high safety standards and to help minimise disruption to Rail Services.

Sub-section 2; Service.

Rail services will be provided and operated by HR. In order to facilitate precise and cost effective, and well as easier to control, management the day-to-day operations of Rail services will be handled by three seperate subsectors within HR.
These subsectors are:

1. INTERCITY;
2. Provincial;
3. Railfreight.

Sub-paragraph 1: INTERCITY.

INTERCITY operates all high-speed long-distance inter-urban passenger services throughout the Country.
INTERCITY is operated as a stand alone company within HR and is responsible for the day-to-day operations of all services within its operational remit.
INTERCITY is allowed to compete directly with other forms of transport within the Imperial Republic (Air, Road, Water etc), though attempts will be made to fully intergrate services within HR and to local public transport services in order to facilitate ease of public use.
INTERCITY is operated for profit, as well as for public service reasons, and is priced accordingly.
INTERCITY is allowed to vet and propose requirements for the purchase of modifications to existing, and the purchase of new, rolling stock required to operate services. These orders are to be passed through the HRB and the Ministry.

Sub-paragraph 2: Provincial.

Provincial operates all regional and local passenger services throughout the Country including, but not limited to;

- Local and medium distance stopping services,
- Commuter services,
- PTE sponsored services.

Provincial is operated as a stand alone company within HR and is responsible for the day-to-day operations of all services within its operational remit.
Provincials primary funcition is to provide affordable rapid transportation of passengers and as such operates services in a "public good" provision rather than a "for profit" requirement, unlike INTERCITY.
Provincial is allowed to vet and propose requirements for the purchase of modifications to existing, and the purchase of new, rolling stock required to operate services as well as operating spare "hand-me-down" rolling stock no longer required for INTERCITY use allowing for accelerated journey times on existing services whilst keeping costs to a minimum. All new rolling stock orders must be passed through the HRB and the Ministry.

Sub-paragraph 3: Railfreight.


Railfreight operates all freight operations throughout the Country. In order to streamline operations, Railfreight operates three specialist subsectors. These are:

- Railfreight Distribution (RfD);
- Railfreight Heavy Haul (RHH);
- Railfreight General (RfG).

Sub-paragraph 3.1: Railfreight Distribution.

Railfreight Distribution (henceforth referred to as RfD) operates all pick-up, block, container or intermodal, and 'high-speed' freight services.
RfD operates on a 'for profit' basis and is allowed to compete directly with road, air, and sea based transport for distribution and operational contracts.
RfD has operational control of all freight services travelling at speeds of 75mph or greater. Due to these higher speeds, RfD services are limited to train weights of no greater than 1500 tons.

Sub-paragraph 3.2: Railfreight Heavy Haul.

Railfreight Heavy Haul (henceforth referred to as RHH) operates all 'heavy' freight services.
'Heavy' freights are designated as goods such as:

- Coal;
- Metal ores;
- Non-palletised metals and scrap;
- Any freight service at a loaded service weight of 1500 tons+.

RHH operates on a 'for profit' basis and is allowed to compete directly with road, air, and sea based transport for distribution and operational contracts.
Due to the heavy loadings of RHH designated freight services, all RHH freight services have a maximum operating speed of no more than 75mph in order to guarantee breaking distances.


Sub-paragraph 3.3: Railfreight General.

Railfreight General (henceforth referred to as RfG) owns and operates all additional railfreight services and rollingstock not already utilised by either RfD or RHH.
RfG's primary duties include:

- Parcels and Mail services (including newspaper deliveries);
- Additional rescue (or Thunderbird) locomotives;
- Weedkiller and Track Clearance duties;
- Private Owner locomotive provision.

RfG operates on a 'for profit' basis and is unique in HR operations as its locomotives are available for private hire by private companies. These operations operate through use of Private Owner Wagons, which are bought by private companies purchasing specific rolling stock to operate their own services and hiring locomotive traction from RfG to haul those services.
Maintenance on private owner wagons is carried out at HR maintenance facilities, after consultation and pricing agreements are reached with private owners.
RfG locomotives are designated as 'mixed traffic' allowing them to operate at higher speeds than would otherwise be capable by RHH locomotives, but are less powerful than RfD locomotives. Due to the haulage limitations of RfG locomotives RfG operated services are limited to a maximum service weight of 800 tonnes.

Sub-section 3; Hobrazian Railways Engineering Limited.

Hobrazian Railways Engineering Limited (henceforth referred to as HREL) owns and operates all heavy maintenance and repair facilities as well as providing for new construction of new rolling stock and locomotives.
HREL is not involved in day-to-day maintenance of rolling stock, which is carried out throughout the Country at maintenance depots, but is based at two primary sites.
Locomotives and Multiple Units are maintained at facilities near New Krupskaya whilst non-powered rolling stock is maintained at facilities in Wollog. These facilities are utilised to completely strip all rolling stock and fix large scale damage and to completely 're-fit' stock, including full maintenance exams, rewiring electrical systems, re-upholstering internals of carriages, etc.
HREL also constructs new rolling stock for HR as well as outside contracts to other Countries.
HREL does not build or manufacture power plants or other such internal power equipment for locomotives, but does fit them into HREL constructed bodyshells.




Article 3.
Light Rail.

Light Rail services and Infrastructure are to be owned by either National Government, through the auspices of the Ministry, or by Local Government with Ministry assistance if required.
Operation of Light Rail schemes can, in certain circumstances (to be expanded below) be operated by either National or Local Government or by Private operators with the agreement of the Local Council.
Light Rail schemes, for the purposes of this bill, are described as:

- Local Tram networks/services;
- Local Underground networks/services;
- Astoria City Underground (due to the nature of the system and network and its importance to the Nation as a whole, Astoria City Underground is a special case within National Transport Infrastructure).

Sub-section 1; Local Tram networks/services.

Local Tram Networks and Infrastructure are owned via Local Government, with provision of support from the Ministry. These networks are planned and constructed by the Ministry in direct partnership with Local Government whilst day-to-day maintenance, operation and construction of these networks will be carried out by the Local Government.
Local Tram Services are provided by Local Government or sub-contracted Private Tram Operating Companies.
In areas where Local Tram Services are owned by Local Government those services will be owned, operated and maintained by Local Government Tram Operating Companies. These companies will provide all Inner-Urban, Suburban and Rural Services throughout their operating sectors.
Local Tram Services are operated for profit, as well as for public service reasons, and services are priced accordingly. Limited subsidies will be made available from National Government, via the Ministry, in assisting operations of services in those areas where limited income streams are available but where Local Government deems services will still be required for Public good or traffic reduction schemes.
In the instance that Local Governments sub-contract to Private Tram Operating Companies a Local Franchise Agreement will be agreed with the Private Operator. Local Government(s) will allow the Private Company to operate services only within defined "Franchise remits" (to be agreed upon by Local Government(s) and the Ministry) and services within those franchises will be operated, owned and maintained by Private Companies for the term of the franchise agreement.

Sub-section 2; Local Underground Networks/Services.

Local Underground Networks and Infrastructure are owned via Local Government, with provision of support from the Ministry. These networks are planned and constructed by the Ministry in direct partnership with Local Government whilst day-to-day maintenance, operation and construction of these networks will be carried out by the Local Government.
Local Underground Services are provided by Local Government or sub-contracted Private Underground Operating Companies.
In areas where Local Undergound Services are owned by Local Government those services will be owned, operated and maintained by Local Government Underground Train Operating Companies. These companies will provide all Inner-Urban and Suburban services throughout their operating sectors.
Local Underground Services are operated for profit, as well as for public service reasons, and services are priced accordingly. Limited subsidies will be made available from National Government, via the Ministry, in assisting operations of services in those areas where limited income streams are available but where Local Government deems services will still be required for Public good or traffic reduction schemes.
In the instance that Local Governments sub-contract to Private Underground Train Operating Companies a Local Franchise Agreement will be agreed with the Private Operator. Local Government(s) will allow the Private Company to operate services only within defined "Franchise remits" (to be agreed upon by Local Government(s) and the Ministry) and services within those franchises will be operated, owned and maintained by Private Companies for the term of the franchise agreement.

Sub-section 3; Astoria City Underground.

Astoria City Underground Infrastructure, including but not limited to;
- Track,
- Stations,
- Depots and Maintenance Facilities,
- Signalling,
- Rolling Stock,
will be owned and operated by Astoria City Underground. Astoria City Underground is a publicly owned Underground Rail Company operated by the Astoria City Underground Board (ACUB) under the auspices of the Ministry.
All maintenance of Track and related Infrastructure will be carried out "In House" to help maintain high safety standards and to help minimise disruption to Underground Rail Services.
Astoria City Underground is operated for profit, as well as for public service reasons, and is priced accordingly.
Astoria City Underground is allowed to vet and propose requirements for the purchase of modifications to existing, and the purchase of new, rolling stock required to operate services. These orders are to be passed through the ACUB and the Ministry.
Astoria City Underground is allowed to propose and construct new routes within its operational remit for the improvement of services in and around Astoria City and its outlying districts. These proposals are to be passed through the ACUB and the Ministry and will be constructed with the agreement of the Astoria City Council.




Article 4.
Waterways and Ports.

Sub-paragraph 1; Canals.

Internal canal systems and all related paraphernalia (including locks etc) are owned by the National Government under the auspices of the Ministry. These networks are planned and constructed by the Ministry in direct partnership with Local Government.
Day-to-day maintenance, operation and construction of these networks will be carried out by Local Government. This maintenance can either be carried out "in house" via Local Government maintenance contractors or the Local Government can, should they wish, out source to Private Maintenance Contractors.

Sub-paragraph 2; Rivers.

River systems are owned by the National Government under the the auspices of the Ministry.
River banks are under the ownership of whomever owns the local property, whether it be National or Local Government or private land owners.
Construction of schemes alongside rivers can be carried out by either the Ministry, Local Government or land owners but all schemes must be passed for planning and environmental damage before any construction may be started.

Sub-paragraph 3; Ports.

Ports are owned, constructed and maintained by Private Shipping Companies under regulation by the Local Government and the Ministry.
All new dock and facility construction must pass planning and environmental concerns before construction is allowed to take place.
As Ports are deemed as vital infrastructure the Government takes claim to 40% of all shareholdings and is paid as a shareholder within those companies. Controlling stakes are maintained by the Private Shipping Companies, although the Ministry does not rule out competitive purchase of shares should it been seen as economically viable.
In the instance of a National emergency, all port and shipping operations come under the control of the Ministry.

Sub-paragraph 4; Shipping Operations.

All shipping operations (including passenger and freight services both National and International) are owned by Private Shipping Companies. These companies come under health and safety regulations imposed by the Ministry but operate in whatever way the Companies may wish so long as it does not harm the environment or the safety of their passengers/crews.
All ownership, operation, maintenance, and purchase of equipment is controlled by the Private Shipping Companies with no subsidy from the Ministry.




Article 5.
Airways.

Sub-section 1; Infrastructure.

Airports are owned, constructed and maintained by Private Aeronautics Companies under regulation by the Local Government and the Ministry through the Independent Hobrazian Airports Authority (IHAA).
All new runway and facility construction must pass planning and environmental concerns before construction is allowed to take place.
As Airports are deemed as vital infrastructure the Government takes claim to 40% of all shareholdings and is paid as a shareholder within those companies. Controlling stakes are maintained by the Private Aeronautics Companies, although the Ministry does not rule out competitive purchase of shares should it been seen as economically viable.
In the instance of a National emergency, all Airports and flight operations come under the control of the Ministry.

Exceptions to the above rules include:

- Astoria City Airport,
- New Krupskaya International,
- Kiduran Airport,
- Muzal City Aerodrome.

The above mentioned Airports are under the direct ownership of the Ministry and, like their private counterparts, are regulated by the IHAA and are expected to operate within the same environmental and planning regulations as laid down for Private operators.

Sub-section 2; Service.

Sub-paragraph 1; Hobrazian Airways.

Hobrazian Airways (HA) is a Publicly owned Aero Company providing National and International Services originating from Astoria City Airport, New Krupskaya International, Kiduran Airport and Muzal City Aerodrome.
HA is allowed to compete directly with other forms of transport within the Imperial Republic (Air, Road, Rail, Water etc), though they are expected to make attempts to fully intergrate services with local public transport services in order to facilitate ease of public use.
HA is operated for profit, as well as for public service reasons, and is priced accordingly.
HA is allowed to vet and propose requirements for the purchase of modifications to existing, and the purchase of new, planes as required to operate services.

Sub-paragraph 2; Private Operators.

Private Aircraft Operators are allowed to operate both National and International services within the Imperial Republic, but are expected to operate within the regulations as laid down by the IHAA and the Ministry.
In the instance of a National emergency, all flight operations come under the control of the Ministry and all companies are compensated for any costs incrued at up to 120%.

Artcle 6

The National Grid

In order to guarantee that the energy generated by the generation facilities is forwarded to the energy consumer suppliers in a cost effective and service guaranteed way, the National Grid will be operated by a publicly owned company. This company can guarantee infrastructural safety and service quality more readily than the Private company due to its ability not to have any requirement to return high levels of profits to its investors and shareholders.
The company will operate in such a way so as to provide the infrastructure and energy delivery services at, or just above, cost so as to allow the largest freedom for energy consumer suppliers to guarantee the lowest possible charges to the consumer.
