It is well documented that most people accused of a crime are from the low end of the tax bracket in our nation. These people cannot afford a high priced private attorney to defend them. Thus, following the principles of justice and democracy we must allow our courts to provide the accused party with a public defender, if the accused cannot afford a private attorney. Currently, we publically fund the court's prosecutors and as such we must also fund a public defense lawyer in order to democratically afford equal rights to the accused who must have the same legal expertise available to them to prove their innocence just as the prosecution has the legal expertise to prove guilt. Therefore, upon approval by the Congress of National Deputies it shall henceforth be mandated that all courts provide a public defense attorney for the accused party, should that party be unable to afford a private attorney. |
