§1
This bill shall introduce 7 law books designed to record all law made in or by Malivia that does not use pre-formulated text.

§2
The following books shall be introduced:
1. Malivian Book of Amendments. In this book, all laws designed to specify, explain, describe, restrict pre-formulated law, or that stand in any closer relationship similar to the above with pre-formulated law will be written.
2. Malivian Private Law. In this book, all laws designed to regulate juridicial bonds between private citizens that don't meet the descriptions of 1. will be written.
3. Malivian Penal Code. In this book, all laws designed to regulate penal matters that don't meet the description of 1. will be written.
4. Malivian Public Law. In this book, all laws designed to regulate matters between officials of the state acting in matters of the state and in execution of their state given powers, and between said officials and private citizens, that don't meet the description of 1. will be written.
5. Malivian Book of Treaties. In this book, all laws, treaties, and regulations designed to regulate the relations between Malivia and other subjects of international law that don't meet the description of 1. will be written.
6. Gerajan Decrees of Malivia. In this book, all laws and regulations that are made in direct relation to the Gerajan religion, the Geraja officials, or Malivia in its nature as a Gerajan state, even if they were to meet the description of 1. will be written.
6b. If laws were to be written into the Malivian Book of Amendmends, that meet the description of 6., they shall only be recorded in the Gerajan Decrees of Malivia.
7. The Constitution of Malivia. In this book, all constitutional laws of Malivia, that are not purely pre-formulated, shall be written. All laws that require a consense of 2/3 of the legislation are deemed constitutional. Laws can be declared constitutional in retrospective by a law that also requires 2/3 of the legislation.
7b. If constitutional laws meet the descriptions of 1., they shall still be only recorded in the Constitution of Malivia.

§2a
All laws that have to be written into the hereby created books shall only be written into them by a reference to the original act (by linking).

§2b
Laws of higer importance shall be written as a whole into the books. Laws of higher importance have to declare this importance in their text, or have to be declared to be of higher importance ex post by another act.

§2c
Hereby, the Official Laws of Malivia Act is declared to be of higher importance.

§3
When this law comes into effect, all laws that don't use pre-formulated text existing in Malivia until the day this law comes into effect, will be null and void.

§3a
It will be possible for laws that have become null and void by §3, to be reinstated without having to be sanctioned by the Parliament. Which laws will become reinstated, is for the Minister of Justice to decide.

§4
The duty of writing these books and of keeping them up to date lie with the Minister of Justice. If the Minister of Justice does not fullfill this duty, and waits for more than 4 years to actualise it, he shall be replaced by the Head of Government. For the time between the end of the 4 years deadline and the introduction of a new minister, the Präsident will lead the Ministry of Justice.

§5
For this law to pass, at least 2/3 of the legislation have to vote in favour.

§6
All laws that have to be written into the hereby created books shall only be written into them by a reference to the original act (by linking).

§7
Laws of higer importance shall be written as a whole into the books. Laws of higher importance have to declare this importance in their text, or have to be declared to be of higher importance ex post by another act.

§8
Hereby, the Official Laws of Malivia Act is declared to be of higher importance.

MessageWe honestly don't see how this law could hurt the opposition's rights. And we don't see how liberalism is bound to a case law system.
We don't see the benefits of a case law at all, and we find it necessary, especially for the freedom of the people, that written law is introduced and hence maintained as the only legal form of law.

Sagen Sie, wo gibt es mehr Rechtssicherheit, wo kann man sich eher darauf verlassen, dass gleiche Fälle gleich beurteilt werden - in einem System, in dem Urteile jederzeit "overruled" werden können, oder in einem System, in dem man im Gesetzbuch nachschauen kann?

MessageIn Einem System das seit Jahrhunderten in unserem Land Anwendung findet!Der oberste Gerichtshof fällt Urteile die nicht mehr durch eine höhere Instanz aufgehoben werden können.Ich hoffe ich muss das Ihnen nicht erzählen.(*opposition laughs*)

When this law comes into effect, all laws that don't use pre-formulated text existing in Malivia until the day this law comes into effect, will be null and void.
This regulates the law and destoys our exsisting laws.

And let's talk also about the number of books.They are too many.This only produces beaucracy and costs.

Al in all this reform is big mistake and destoys th tradition of our country.

MessageDass die Urteile des Obersten Gerichtshofes nicht mehr aufgehoben werden können, da er die letzte Instanz ist, wird sich auch durch dieses Gesetz nicht ändern.
Was das mit Rechtssicherheit zu tun hat, ist uns nicht ersichtlich. Im vorherrschenden System, um zu wissen, wie ein bestimmter Rechtsstreit ausgehen wird, müssen sich die Parteien durch unmengen von Gerichtsakten durchwühlen. Durch Gesetzbücher wird dies vereinfacht.

7 Gesetzbücher sind sehr wenig. Mehr Bürokratie bedeutet mehr Arbeitsplätze.

MessageSie geben damit einer Königrechte, nämlich das Recht des Parlaments Gesetze für ungültig zu erklären aus der Hand und übergeben es der Exekutiven.
Das Wort der Exekutiven steht über dem des Parlaments.
Aber das das ihre Vorstellung von Demokratie ist, finde ich keineswegs besonders.

Hoffen wir darauf, dass die Sprengung der Gewaltenteilung ein Ende findet.

MessageTheoretisch, ja. Wir werden allerdings nur von der Opposition vorgeschlagenen Gesetze wiedereinsetzen.

Dieses Gesetz ist rein organisatorisch gemeint, und soll einer Sammlung von Gesetzen dienen, die nicht nur aus automatisiertem Text bestehen. Das wäre insofern praktisch, als dass man in Zukunft einfach nur in diese Gesetzbücher schauen müsste, und nicht die ganzen bisher beschlossenen Gesetze durchsuchen müsste, um solche Gesetze zu finden.
Wenn. z.B. eine Partei ein Gesetz durchbrächte, in dem nur steht, wie die malivianischen Gerichtshöfe genau heißen, dann müsste man, ohne dass diese Gesetze irgendwo gesammelt werden, als neue Partei ewig nach so einem Gesetz suchen, oder es würde einfach irgendwann vergessen werden.

Das ist keineswegs ein Versuch, die bisherigen solchen Gesetze einfach beiseite zu schaffen, daher die Bitte an die Opposition, Gesetze aufzuzeigen, die erhalten bleiben sollen.
