Description[?]:

This law want to create laws in order to regulate the use and other important aspects of the identity ducuments.

Paragraph 1:
The government prohibits the issuance of ID cards and the previously stored data will be deleted.All identity cards are invalid and it is forbidden to ask for the ID card.

Paragraph 2:
Every foreigner who wants to be in the Republic of Malivia longer than 3 weeks, must register him or herself in the national and central NATIONAL FOREIGNER REGISTER (NFR).

Following datas must regist there:
1.)Biometrical photo
2.)Full name
3.)Adress (in Malivia)
4.)Fingerprints from every finger
5.)Birth date
6.)Ancestors and relatives (in Malivia)
7.)Colour of the eye
8.)The date of issue
9.)Citizenship
10.)Religion
11.)Race
12.)Work place
13.)Date of Expiration (of the card)
14.)Personal number
15.)Gender

2.1) Every person, who register him or herself in the register, then he/she get the new NATIONAL FOREIGNER CARD. This card is mandantory for every foreigner and he/she has to carry that card all times.
2.2) Acceptions for this can made for certain citizens of foreign nations, if a treaty between our nation and the nation of the foreigner were made.
2.3) The foreigner card is valid for 5 years and costs 45 MCR and the ministery for internal affairs is competent for these cards.
2.4)The card is modern. The card has a RFID chip and other security features.
2.5) It is phoibited to fake the FOREIGNER CARD or to give wrong informations to the registry. Persons who to do that, get punishments up to 500.000 MCR or up to 2 years in prison and will remove form this country.
2.6) The personal number opens the door to social services.
2.7) Changes to the datas, given to the NFR must admitt into the time period of 2 weeks. If that doesen't happen, a fine must be payed of at least 1500 MCR.

Paragraph 3:
Volunteer passports for the Citizens of the Republic Of Malivia are issued in the future with the following data:

1.)A volunteer photo
2.)Citizenship
3.)Full Name
4.)Birth date
5.)The competent authority
6.)Colour of the eye
7.)The date of issue
8.)Expiration Date
9.)

Before making the passport, it is the dutiy of the competent authority, to make clear, that the photo is volunteer. It is forbidden to save these dates on RFID or other electronic data carrier.
The police have only acess to the datas, if an independent court has approved that or if the concerned person approved that measure. After 2 years the police has to delete all the safed datas.

3.1 The passport is valid for 15 years and costs 15 MCR. In the passport there are several security features to prevent forgeries. The passport is issued by the central goverment and is the same in every part of the country.
3.2 It is phoibited to fake the passport. Persons who to do that, get punishments up to 500.000 MCR or up to 2 years in prison.


Pargraph 4:
The driving licence has following datas:

1.)Name
2.)Nationality
3.)The date of issue
4.)The competent authority
5.)Volunteer photo

For the driving licence follows the same rules as for the passport, but the datas will be saved at the local level. Every city has to maintain such a non-electrical registry. It is not allowed to put the datas together with other cities and towns.

Pargraph 5:

It is allowed for the police or the government to ask citizens of the Republic of Malivia for their passport or their driving licence for grounded case.
Private companies can ask citizens for the driving licence, but they must accept them even if they don't have photos.

Paragraph 6:

Article 1,Pargraph 1,2 and thee of the International Opening Act will become invalid.


This law comes into effect, after the law was passed by the parliament.

MessageIn regards to foreigners, this law is very discriminating. There is no reason why foreigners should carry their identity papers with them all the times, and no reason why it should contain features such as fingerprints, when the passports we issue to our citizens even don't have a mandatory photo.
Even if we recognised that there are some states out there that are likely to produce unwanted foreigners, it would be sufficient to maintain a register for countries, whose residents have to have such passports.

But we don't see why other countries should accept the Malivian passports, if they aren't even up to the standards we're setting for their passports.

Apart from that, we don't see what's so important about the voluntarily given photo that prevents it from being mandatory.

We also don't see why governmental institutions should not be allowed to ask for passports, since they would be a valid tool for determining the citizenship of the concerned citizens, and is not really a useful tool for whatever you suspect the government to do with information.

MessageWe propose the following changes, if they are accepted, we will vote in favour:

Foreigners should not need to have their race or their religion registered.

The police should only be able to ask for a passport if they have grounded case.


If it is forgotten to admitt changed data (this is not the case if wrong data is submitted), there should only be a fine, not a prison sentence, and the fine shouldn't be that high. If the changes haven't been submitted in order to further some criminal activities, the accused should be tried separately for these activities, not that he didn't change the date.
