MessageMr Speaker,

it is one of the universial rights of every human, that he can get a process in the borders of his own country. Only there, he can understand the languange for example.
Does the goverment ignore this fact?

MessageMr Speaker,

No, it is not. Everyone has the right to have a fair trial. This Government believes that someone should be trialed is the nation where he/she committed his/her crime. Our Embassies will give juridicial advice to the accused and monitor every trial if necesarry.

MessageMr Speaker,

in a foreign country it might be not possible to help the acussed. Maybe they can't visit them or it itsn't allowed to monitor the trail. Mr Speaker and then the right of a fair trail is violated, because no one can guranteer such things.
Does the government see this point, and does she think a fair trail is less worthy then some improvement of international relations?

MessageMr Speaker,

may I suggest a compromise on that. We only extrade Malivian Citizens, if the other state guranteers a fair trail and let us help the acussed.

MessageMr Speaker,

we support the latest idea of the KPM. We should only allow our citizens to be extradited if the state in question can guarantee a fair trial.

MessageMr Speaker,

We have no problems with KPM's suggestion either. It's added to this proposal.

MessageMr Speaker,

this is not enough.

a.)The nation where the Malivian citizen will be trialed has to gurantee (in written form) the Malivian Government that the accused will have a fair trial according to Malivian standards
b).The nation where the Malivian citizen will be trialed has to gurantee (in written form) the Malivian Government that the accused has the opportunity to receive any support needed from the Malivian Government.
c)Every Malivian Citizen has the right to sue against an request for extradition before a Malivian Court. If the Court decides against an extradition, then the government has to accept this. The last instance is the Constitutional Court

Random fact: By default the head of government is the ultimate authority within a national government. In general terms, heads of government are expected to consult with cabinet colleagues (including those from other parties) before making significant decisions but they remain responsible for government action.
