Judicial Impeachment & Removal Act
Proposed By: Federal Independent Party
Authored By: Senator Daniel Alvaren (Fuwan)
Introduction Explanation:
This Resolution would effectively establish a legal process for the impeachment and removal of a Justice of the Supreme Court of Solentia

Article I: Senate Findings

Section 1) The Senate finds that under the current system, there is no formal and legal way to impeach a Justice of the Supreme Court.

Section 2) The Senate finds that under the current system, a Justice of the Supreme Court that is truly incompetent of his/her duties and ignorant of judicial efficacy may govern over the laws of Solentia without repercussion.

Section 3) The Senate finds that there must be a process of removing a Justice of the Supreme Court that displays an inability to meet the demands of the Solentian legal system.

Article II: Definitions

Section 1) Justice of the Supreme Court is also known interchangeably as Chief Justice and/or Associate Justice.

Section 2) Senate is also known interchangeably as the legislature of Solentia or simply legislature.

Article III: Impeachment

Section 1) In order to begin a motion for the process of impeachment, the filing party or parties must bring a report to the Senate listing the wrongdoings and improper rulings of the incumbent Justice of the Supreme Court.

Section 2) After a series of debates and discussion regarding the findings, the Senate must vote to confirm the findings. A simple majority is required to do so. Once confirmed, the Senate will officially impeach the Justice of the Supreme Court's actions and administration.

Section 3) After the findings are approved and impeachment is officiated, the Senate may move onto the process of removal.

Article IV: Removal

Section 1) Should the Senate decide it is in the Supreme Court's prevailing interests, it may vote to remove the impeached Justice of the Supreme Court.

Section 2) The Senate will hold a vote specifically addressing the act of removing the Justice of the Supreme Court. Removal of a Justice of the Supreme Court mandates the acquisition of 2/3 of the Senate voting in the affirmative.

Article V: Vacancy

Section 1) Should the Senate remove the Justice of the Supreme Court, the duty of filling the court vacancy is relegated to the incumbent Head of State or sitting executive. The executive shall follow the process prescribed according to SR 009: Supreme Court of Solentia Act of 2943.

Article VI: Rules

Section 1) This resolution requires 50% + 1 majority in the Senate in order to pass.

Section 2) This resolution is a binding piece of law and shall require 50% + 1 of the sitting Senate in order to repeal its status as law. This resolution, upon becoming law, will remain in place until a piece of legislation specifically addressing its existence overturns it.

MessageBy and large this farce of a Supreme court was picked with FIP And CPS favorites, with a few token nods to anyone else. Now they enact the next part of their nefarious plot by making it politically expedient to remove anyone who does not toe their ideological line. It's clear to anyone with senses.

The Calydon Government does not recognize this body.

Message"Mr. Premier,

How is a fifty-percent-plus-one vote expedient? How is a two-thirds vote expedient? There is no expedience in this legislation; it takes all pains necessary in order to ensure that only Justices who have not fulfilled their duty to Solentia are impeached and removed. There is no FIP-CPS plot here, merely an important check on the Judicial system which was overlooked at the creation of the Supreme Court.

I yield."

Message"Although it is most probably going to result in a quick departure for Justice York in this highly emotional time of rather jittery Justice and Internal Ministires, we recognise the requirement for dangerous men to to be removed from the Court if their intent and threat is evident."

Random fact: In cases where players introduce RP laws to a nation and then leave, Moderation reserves the discretion to declare the RP laws void if they appear to have fallen into disuse. In particular, please bear in mind that a player who is inexperienced with Particracy role-play and has joined a nation as the only party there should not generally be expected to abide by RP laws implemented by previous players who have been and left.
