MessageArticle 1 is perfectly acceptable. Article 2 would recreate the ineffective system which has only recently been amended. Article 3 creates a jurisdictional void, local governments will have serious problems with crimes committed across jurisdictional lines. The authority of the local governments is delegated them by the representatives of the nation, we should at least honour the national government equitably with the local governments.

MessageIn retrospect, you are right about Article 3. The PNCA will withdraw that Article. As to Article 2, what is ineffective about that system? It stands to reason that regional courts should deal with regional law and national courts should deal with national law. For the national courts to intervene in matters of regional law would undermine the authority of the regional governments.

MessageOne problem with the system is the inefficiency of having separate national and regional courts, it adds unneeded levels of bureaucracy and expense to the taxpayers. The more prudent problem would be in the lack of regional involvement in cases of national law which relate to the region in question.

MessageSurely a case which relates to a specific region should be a matter of regional law, not national law. Under the old system, regional cases were tried by regional authorities and national cases by national authorities. Also, since there are already national courts (albeit with only appellate jurisdiciton), any added expense would not be a severe as you claim.

MessageAll cases occur in regions within the nation, therefore all cases are regional and national. The expense would be in the regions establishing the same levels of appellate courts that the national government has and in the nation establishing the trial court system which the regional governments have. The expenses could be reduced in part by the sharing of courthouses and judges by the regions and the nation, although such a measure would make the change an inconvenient formality.
