Issues of lawsuits for malpractice or related issues must balance the needs of holding practitioners accountable and reducing frivolous lawsuits. Studies indicate that the excessive settlements that have proliferated in the nation do not have much positive effect in reducing negligence. They do, however, significantly raise the price of malpractice insurance and related insurances. A moderate cap on tort reform is recommended to reduce the frivolous lawsuits and balance the needs of our systems of healthcare and industry. |
