Description[?]:

The following bill is being proposed to strengthen Beluzia's foreign policies and its resultant affairs. Once passed, the articles thereby become part of the Laws of the Land, in support of the other laws of the Constitution, deeming the earlier articles amended or completely removed from significance. (i.e. to be mentioned in and as the Foreign Policy Agenda of Beluzia's 'Laws of the Land' Charter, also called the Federal Laws, as per the Constitution.)


[An Intelligence department under the control of the Foreign Affairs Ministry, which will again be directed by the President directly, and in joint cooperation with other relevant ministries/department s as may be deemed necessary, is proposed in the policy framework; details of which would be produced soon as a separate bill. Details may be added as Clause afterwards, once produced and considered.]

[Clauses of the Foreign Aid policies, Mission Establishment Protocols, Passport and Visa Applications, Personnel Selection, Crisis Situation, and Secrecy Protocols will be considered as a separate bill, proceeding to this original foreign policy bill, for better scrutiny from finance ministry and other concerned ministries/departments.]



Foreign Policy of the Federal Republic of Beluzia


 Introduction:

The foreign policy of Beluzia is the way in which it interacts with foreign nations and sets standards of interaction for its organizations, corporations and individual citizens. The global reach of Beluzia is backed by the economy, resources (people, environmental, mineral), and a tremendous defence and research budget, which accounts for a huge percentage of the global spending. The Foreign Affairs' Minister is officially charged with state-to-state diplomacy, although the Head of State and Head of Government/Chairperson (President) has ultimate authority over foreign policy; that policy includes defining the national interest, as well as the strategies chosen both to safeguard that and to achieve its policy goals.

The official goal of the foreign policy of Beluzia:

"To create a more secure, democratic, and prosperous world for the benefit of the Beluzia and the international community."


The Beluzia Government's Ministry of Foreign Affairs states as some of its jurisdictional goals (in no significance order); considering advice from other ministries/departments when deemed necessary:

• "Export controls, including control of nuclear technology and nuclear hardware leading to eventual non-proliferation;
• Measures to foster commercial intercourse with foreign nations and to safeguard Beluzian business abroad; international commodity agreements;
• International education, health;
• Protection of Beluzian resources, citizens abroad and expatriation/repatriation."


 Powers of the President, Ministry and Cabinet:

The Beluzian Constitution gives powers of the foreign policy decision-making to the Presidency, carried out by the Foreign Affairs’ Ministry, but the entire Cabinet has a role in ratifying treaties, and the Supreme Court interprets treaties if cases are presented to it.

Subject to the advice and consent role of the cabinet, the President of Beluzia, through the Foreign (may also be called External) Affairs' Ministry negotiates treaties with foreign nations, but treaties enter into force only if ratified by at least two-thirds of the Cabinet. The President is also Commander in Chief of the Armed Forces, and has broad authority over the armed forces (Defence laws reference); however only Cabinet, under the President's consent who is specially advised by the Foreign Affairs Ministry, has authority to declare or end war, proclaim support or withdraw support for war, provided there is at least two-thirds majority; and the civilian and military budget is written by the concerned Ministry, subject to entire Cabinet two-thirds majority approval. Cabinet thus, has power to initiate and help regulate commerce with foreign nations or entities.

The Beluzia Foreign Affairs' (Foreign) Minister is the primary conductor of state-to-state diplomacy. The Ministry is held as a part of the elected Cabinet, in its own centralized office space in Tackstov, Beluzia and other mission locations nationally and worldwide, and the Foreign Minister is appointed by the President with the advice of the Cabinet [same rules of selection as described in Constitution], and Ambassadors/High Counselors (whichever higher) [same rules of selection as described in Constitution], International Research and Analysis Wing (I-RAW) are then directly appointed by the President, with the advice and consent of the Ministry. The concerned Intelligence and Defence and other departments/ministries take the responsibility of appointing other personnel at various levels as given in the Constitution, and as per their individual laws of working that are accepted.


 Law:

Three types of treaty-related law:

• Executive agreements-
Cabinet- executive agreements are made by the President and Cabinet. A majority of two-thirds makes it binding after it is signed by the President.
Sole executive agreements are made by the President alone, if deemed necessary by the President.

• Treaties are formal written agreements specified by the Constitution. The Foreign Affairs' Ministry, with the advice of the President, makes a treaty with foreign nations, but then the proposed treaty must be ratified through a two-thirds vote in the whole Cabinet. The Supreme Court rules that the power to make treaties under the Beluzian Constitution is, though a Federal Government responsibility, a power separate from the other enumerated powers of the federal government, and hence the federal government can use treaties to legislate or influence legislation in its special zones, states and areas which would otherwise fall within the exclusive authority of the states.

Further, Beluzia incorporates treaty law into the body of federal law. As a result, Cabinet can modify or repeal treaties afterwards with a two-thirds majority. It can overrule an agreed-upon treaty obligation even if this is seen as a violation of the treaty under international law, provided there is two-thirds majority and the President's explicit consent.

Generally when Beluzia signs a treaty, it is binding. However, Beluzia adds a reservation to the text of every treaty appropriately that says, in effect, that "Beluzia intends to abide by the treaty, but if, within 5 full working days of the signing, the treaty (or a part or parts of the treaty) is found to be in violation of the Beluzian Constitution, then Beluzia cannot legally abide by the treaty (again, or a part or parts of the treaty, respectively) any further, since the Beluzian signature would be ultra vires."


 The following objectives are defined in the War on Terror and other atrocities:

Defeat terrorists, ban and demolish their organizations.

Deny sponsorship, support and sanctuary to terrorists-
o End the sponsorship of terrorism by any nation/organization.
o Establish and maintain a standard of accountability with regard to combating terrorism.
o Strengthen and sustain the international effort to combat terrorism.
o Work with willing and able states.
o Enable weak states
o Persuade reluctant states.
o Compel unwilling states, through peace talks, compel, world united, military persuading process, accepted support to identified humane groups in rebel nations, covert actions as required, in that order.
o Interdict and disorder material support for terrorists.
o Abolish terrorist sanctuaries and havens.

Diminish the underlying conditions that terrorists seek to exploit-
o Partner with the international community to strengthen weak states and prevent (re)emergence of terrorism.

Defend US citizens and interests at home and abroad-
o Involve the National Strategy for Internal Security (NSIS) department (Internal/Home affairs Ministry).
o Attain domain awareness, and heighten intelligence capabilities and international intelligence cooperation.
o Enhance measures to ensure the integrity, reliability, and availability of critical, physical, and information-based infrastructures at home and abroad.
o Implement measures to protect Beluzian citizens abroad.
o Ensure an integrated incident management capability.
o Foreign policy is influenced by the efforts of the government to control imports of illicit drugs, including cocaine, heroin, methamphetamine, and cannabis, etc. (in co-operation with Ministry of Health, Internal Affairs)

All decisions for actions in these regards are made by the President, with advice from the Foreign Affairs Ministry, and two-thirds majority support from the Cabinet.



 Other Policies:

• The government's policy concerning diplomatic immunity-

The Government grants diplomatic immunity and expects its diplomats in foreign missions and Grade-I officers in aid and other missions to be granted diplomatic immunity. Foreign Diplomats are not subject to arrest and prosecution and civil action under all laws of Beluzia, unless deemed to be a national threat. An ‘epelling’ may be required on milder cases or on moral grounds. [In such a case, either of: an extradition, or a prosecution followed after Beluzia’s judicial processes, is followed in mutual consent with the other country, depending on the extremity of the case, future potential, consequence of action and jury award. Such a decision rests in the president’s hand, advised by the Cabinet and the Foreign ministry.]
Beluzian diplomats in foreign nations are expected to be awarded similar immunity, or actions in extreme cases in consultation with the Beluzian Foreign ministry which will then decide on the issue with the President and the Cabinet.

• The government's policy regarding foreign embassies-

Foreign countries may establish an embassy after obtaining approval from the Foreign Ministry. High Counsels are for nations that aren’t completely sovereign, or decide to begin relations with Beluzia, only from the High Counsel level, with intentions of upgrading to an Embassy in the future. Consulates may be opened in cities as deemed important by that country, with added approval from the Ministry. Full beneficiary powers of remaining as an international representative on Beluzian territory will be awarded. [Full participation or assistance in, as per international norms: Property, financial advances, water, clean and secure I.T. technology, waste disposal, stationary, accommodation, transport, etc.]

Alternatives-
o Any other country may establish formal relations through an indirect channel: from an embassy of a country in the same continent as theirs. Beluzian embassies, High Counsels and Consulates will proceed in the same manner too in selected countries, and expect full beneficiary powers of remaining as an international representative on their soil. [Full participation or assistance in, as per international norms: Property, financial advances, water, clean and secure I.T. technology, waste disposal, stationary, accommodation, transport, etc.]

• Citizenship, & travel by nationals to foreign nations-

The Foreign Affairs’ Ministry, under the President of the Government of Beluzia, issues free passport for all born in Beluzia, with at least one of the two parents alive being a Beluzian citizen (also, always including dual citizenship with Beluzia and another country).

All passports are signed by the respective District Passport Commissioners.

(Both parents alive are Beluzian citizens: free issue/compulsory;
One parent alone, alive or dead, holding Beluzian citizenship: voluntary- as per the parent(s) decision;
Both parents with Beluzian citizenship are dead soon after their child’s/children’s birth, or one with Beluzian citizenship and one with foreign citizenship, but both dead soon after their child’s/children’s birth: Beluzian passport is provided to child who is put under national guardian care, or, if available, decision is subject to nationality and will of most immediate relative who is willing to take custody
Both parents, alive or dead soon after child’s/children’s birth citizens of a foreign country: Child/Children is/are safely transported-not deported- to the Father’s-if not available, mother’s- country of citizenship.)

This passport is valid until 18th birthday, and will be issued within 10 working days after birth, on verification of birth document, address proof.
Post 18th birthday, the citizen has to procure a new passport with the same documents, and with additional family/guardian/relation proof document, for a fee not exceeding 100 in currency at any time [40-100; variations depending on passport urgency mentioned.], subject to police credential verification and valid for 20 years’ time.

Renewal of passport due to page exhaustion or other issues, for under-18 involves fresh application with same documents presented on the first passport (after birth) and a fee payment of 10 in currency.
Renewal for 18+ persons at any time on account of time or page exhaustion or for other issues incurs the same process and conditions as fresh application post-18th birthday, with fee not exceeding 50 in currency [25-50; variations depending on passport urgency mentioned].

Error corrections in passport require the documental proof for correction, and all applicants would be issued with a fresh passport in 5 working days’ time.

Alternatives for others-

For nationals of other counties born in Beluzia or outside Beluzia, living in a foreign country or in Beluzia presently, and any one person of up to 2 earlier generations of such a person born in Beluzia: “Person of Beluzian Origin” (POBO) Card will be issued for free on application with self proof of birth, nationality proof, address proof, and older generation’s(s’) authentic proof of birth in Beluzia, to the nearest Embassy/High Counsel/Consulate of their country, or nearest Passport Service Centre in Beluzia. [Only for special travel ease to Beluzia and as a card of identity in Beluzia; no other formal powers.]

For those Beluzian nationals living abroad: As a Beluzian origin, option of holding dual citizenship of Beluzia and that country of living [full powers as Beluzian citizen as well as powers of that of other country]; or Beluzian passport [Beluzian citizen] alone- ‘NRB’ (Non-resident Beluzian) titular category.


• Government policy concerning foreigners’ travel to Beluzia and immigration-

The nation imposes some border controls on all visitors o any visa, with cursory security checks, including bio-metrics and retina-scans (except for Green Card), to confirm visitor identities.
o Everyone is allowed to reside permanently in this nation, through a three-step process aiming at integration of society and individual satisfaction:

Entry through one of the visa methods detailed below, except travel-Post time period of visa, or extension of visa to minimum 1 year: Extension of work/business/resident visas-No earlier than a year of extended visa completion, obtain ‘Green Card’ for 2 years through 3 years, through interview process with the Immigration department of the Foreign Affairs’ Ministry-No earlier than 2 years, apply for and obtain citizenship of Beluzia based on individual records.

Different permits of stay in the country, in terms of:

Travel to any part of the country: minimum 2 days/ visa, maximum 60 days’ travel visa for each individual;
Study at a recognized university/institute of higher education in the country: minimum 3 days’ study permit, or 4 days’-90 days’ short period study visa, 90 days’ upto 15 months’ study visa ( all study visa entails a post-study period visa of up to 1 year automatically; students are encouraged to find work and other opportunities for themselves during this period. Study periods can also be combined with a 20 hour work period every week, with a pay no less than 6 in Beluzian currency;
Work in a company/institution in the organized sector: minimum 30 days’-6 months’ work permit, 6-12 months’ temporary work visa, up to 12- 24 months’ organized work visa.
Work in the unorganized sector: minimum 30days’-6 months’ temporary work visa, 6 months up to 18 months’ unorganized work visa;
Business visa: minimum 1 day, maximum 2-120 days’ business visa;
Resident visa: for any use, with proof of non-commercial self-accommodation for at least a year, and every subsequent accommodation renewal proof, subject to visits of at least 2 days once every 6 months: minimum 12 months up to 3 years’ resident visa.


• International Trade-

The nation mostly imposes reciprocal tariffs on imports, with the lowest import tariff being 0.4% of goods’ value for those not imposing any tariff on our exports, and the highest, being up to 6% more than the tariff imposed on Beluzia.

Alternatives:

o The nation does not allow import of any goods from a foreign nation.
o The nation allows for imports, but imposes protectionist tariffs and quotas on all imports from a nation.
o The nation allows for imports, but imposes tariffs and quotas in certain areas on one or more nations.
o The nation does not export one or more good(s) to one or more countries.

Trade policies are made by the Trade and Industry Ministry, with special consultation on International Trade with the the Foreign Ministry.


• The national refugee policy-

Refugees that are victims of extreme circumstances as recognized by the global community are welcome; those from neighboring land and maritime countries are easily welcome. They are all given integration-aid (medical, food, shelter/camps, education and awareness, psychiatric).

Provisions are: Retaining of national identity document, if any, to become a citizen of Beluzia after 2 years’ of uninterrupted stay through induced self-naturalization;
Or, without any national identity document, become a citizen of Beluzia after 3 years of uninterrupted stay in Beluzia through induced self-naturalization.

Others:

o Beluzia will provide all necessary assistance to bring its citizens back to Beluzia from any troubled/unsafe area at any time, citing all soft power or military, economic means to do so.
