[PREAMBLE] While Rutania has not been the recipient of a terrorist attack, our history suggests that we have had organizations and people who wish to cause our way of life harm. With that in mind, we feel that it is the duty of the government to protect its citizens from people and/or groups whose sole purpose is to interrupt the Rutanian way of life by causing mass chaos. Therefore, we present the Combating and Eliminating Rogue Institutions and Peoples Act (CERIP Act) as a means to deal with enemies of the state internally. [PROVISIONS] Article I. - Warrantless Wiretaps on Individuals/Institutions I. The government shall have the right to use wiretaps against people it deems as such qualify. II. The Ministry of Justice shall carry out the wiretaps. III. A 5-member council made up of Judges not affiliated with the government shall approve or deny the government's request. IV. Legality -While there is a law which allows for an individual's right to privacy, this law shall supersede that right in certain cases. -Such cases occur when the pretext of "terrorism" or "enemy of the state" is used by the government as a means of justifying such actions. Article II. - Warrantless Raids on Institutions I. The Ministry of Internal Affairs in conjunction with the Military shall be authorized to conduct raids on institutions deemed as "terrorist organizations" by the government. II. A military tribunal shall approve or deny any request on raiding an institution. III. Legality -The government may use the pretext of "terrorism" or "enemies of the state" as a means of justifying such actions. Article III. - Deportation of Immigrants Suspected of Terrorism I. Immigrants suspected of terrorism shall be immediately deported back to their home nations without a trial. Article IV. - Declaration of Hacking as a Terrorist Activity I. Any persons who hack, knowingly leak and/or aid in such activities that give the public access to classified government documents shall be deemed an "enemy of the state". II. The Ministry of Justice shall have jurisdiction over such cases involving hacking and their subsequent punishment. Article V. - Seizure of Data Records I. Any person who is under the suspicion of being a terrorist shall have their data records seized by the government without their knowledge II. Legality -While there is a law which allows for an individual's right to privacy, this law shall supersede that right in certain cases. -Such cases occur when the pretext of "terrorism" or "enemy of the state" is used by the government as a means of justifying such actions. [APPENDIX] I. The present bill shall be adopted with 2/3 majority by the Parliament of the Commonwealth of Rutania 1. Amending this bill will require a 2/3 majority 2. Repealing this bill will require a 2/3 majority II. This law will come into effect approximately 12 months after its passage. |
