AN ACT to amend the laws regulating succession to the Crowns of the Empires of Hulstria and Gao-Soto;
GESETZ zur Änderung der Gesetze zur Regelung der Nachfolge der Kronen der Kaiserreiche Hulsterreich und Gao-Soto;

BE IT ENACTED by Her Imperial and Most Illustrous Luthoran Majesty, Kaiserin Josephine of Hulstria, and His Imperial and Heavenly Majesty, Mikado Okatori Akihiko of Gao-Soto, by and with the advice and consent of the Imperial Diet and the Länderrat of Hulstria and Gao-Soto, two thirds of each house concurring therein, at Kien assembled, and by the authority of the same, as follows-

1) Amendment of the Writ on the Regulation of the Line of Succession to the Hulstrian Throne
(1) Section 1 of the writ on the regulation of the Line of Succession (hereafter "the Writ") to the Hulstrian Throne shall be amended to read as follows: "Succession to the throne will be defined by Absolute Primogeniture."
(2) Sections 2 and 3 of the Writ shall be lapsed; a new section 2 of the writ shall read: "Female holders of the Imperial Throne shall pass on the name of Rothingren-Traugott and claims to the throne to their successors matrilineally." A new section 3 of the Writ shall read: "The consorts of female holders of the Imperial Throne shall have the official title of Prince Consort, with the courtesy title 'Imperial Highness'."
(3) Section 5 of the Writ shall be amended to read as follows: "The Reichsversammlung must give its prior approval to the marriage of the Emperor or any candidate; marrying without the consent of the Reichsversammlung disqualifies a candidate from the Succession."
(4) All references to the Council of Nobles in the Writ shall be amended to read "the Reichsversammlung", being the Länderrat of Minister-Presidents and the Imperial Diet in join session;
(5) A new section shall be added to the Writ to read as follows: "Should the Emperor declare to be unfit for the time being to exercise his duties, or be declared in the event of incapacitation, illnes or injury to be such by the Reichsversammlung, the Reichsversammlung shall appoint a regent."
(6) The heir-apparent to the Hulstrian Throne, male or female, shall be accorded the title of "Crown Prince" or "Crown Princess" and the style of "Imperial and Illustrous Highness";

2) Establishment of a Law on the Succession to the Phoenix Throne of Gao-Soto
(1) Succession to the Phoenix Throne and Imperial Crown of Gao-Soto shall be defined by absolute primogeniture;
(2) Female holders of the Phoenix Throne of Gao-Soto shall unless otherwise ordered by proclamation of the reigning Empress ratified by the Reichsversammlung pass on the name of Okatori to their descendants matrilineally;
(3) The consorts of female holders of the Phoenix Throne of Gao-Soto shall have the official title of Prince Consort, with the courtesy title 'Imperial Highness';
(4) The Reichsversammlung must give its prior approval to the marriage of the Emperor or any candidate; marrying without the consent of the Reichsversammlung disqualifies a candidate from the Succession;
(5) Only those of Kamist faith shall be able to succeed or hold the Phoenix Throne of Gao-Soto;
(6) A candidate must have reached a majority of eighteen years of age in order to rule, should a candidate inherit the Phoenix Throne before their eighteenth birthday, a Regent, selected by the Reichsversammlung, shall rule in their name until such a date.
(7) Persons of illegitimate birth shall hold no place in the line of succession unless their parents subsequently wed.
(8) The heir-apparent to the Phoenix Throne, male or female, shall be accorded the title of "Crown Prince" or "Crown Princess" and the style of "Imperial and Heavenly Highness";

3) Commencement
(1) This Act shall enter into force for all children born after the date of its Imperial Assent.

The accession of Her Imperial and Most Illustrous Luthoran Majesty, Empress Josephine to the Hulstrian Throne has given Their Imperial Majesties' Government and may in the Crownlands with us cause for reflection on the state of the monarchy. As the law stands, Empress Josephine only ascended to the throne by declaration of her father, the late Emperor Otto, because females are barred from the succession unless the male line becomes extinct.

Upon examining the rules as we know them, we have found that the current Septembrist character of the Crownlands does not conform to the current rules of succession to both Crowns - in the modern societies we have become, disqualifying females from the throne in this manner seems a relic of earlier times. However grand those may have been, the acceptance with which Empress Josephine was received to the throne speaks that the current role of our monarch has evolved to the point where we should consider a change in the laws.

The bill currently before the Diet modernises the succession laws in several aspects. Most importantly, with the support of both Crowns, we are proposing to replace the current male-preference rule with absolute primogeniture and allow the oldest child of each monarch to inherit regardless of age. Accompanying questions, such as the title of the Prince Consort (we deemed it unduly confusing to allow a male consort to have an Imperial Title, as the "Emperor" is standard constitutional language for the holder of either of the Crowns) and the passage of the family name, have also been modernised.

A second modernisation concerns the rules on the faith. We have decided that due to the ceremonial positions of both Emperors in the dual state religions of the Empires, the rule requiring the monarch to be of the appropriate faith had to be retained. For their spouses, however, we felt that this rule was too strict, but we felt that since the marriage of the heir or the Emperor is a matter of influence to the state - for example, considering the influence on any heirs born of the marriage - the Reichsversammlung should henceforth approve of any marriage. As Staatsminister, though, I would make it abundantly clear that we expect that all further marriages in the Hulstrian Imperial family will continue be blessed by the Luthoran Church, and likewise for the Kamist rituals for marriage in the Gao-Showa Imperial Household. However, the Archbishop of Kien has, upon consultation, indicated that he believes the ceremony of marriage can in principle be conducted between two Hosians of any denominations if necessary.

I call upon the Imperial Diet to ratify the proposed changes with the full strength and unanimity of its will.

For the sake of tradition, I am afraid I cannot do as the Staatsministerin requests. It's not that I'm prejudiced against females, nor against non-Luthorans, but I think both modernisations unduly meddle in what is a finely balanced system.

The Reichsversammlung, however exalted, cannot change the international traditions prevailing among noble families. Yes, we may declare the House of Rothingren-Traugott may continue matrilineally for all we want - but to our cousins in Luthori, the male line of the senior branch will have regrettably become extinct with Emperor Otto's death, with the House itself having become a cadet branch of the House of Hennersdam-Hohenpassen. In the grand scheme of things, that would devalue the Imperial House. Now the Gao-Showan Emperor does not have this problem - after all, he claims to be descended from a godlike first Emperor, albeit very distantly.

The rules on the faith are there for a reason - to protect the state religion. The influence of a spouse on the upbringing of children is considerable - if we do not want to have a non-Luthoran Kaiser for sake of the state religion, then we should rule out any Patriarchal influences on the Kaiser's children as well, or at least ensure that they are raised in the Luthoran faith by methods more cogent.

we support this reform wholeheartedly, as it brings the succession laws in line with modern realities while still recognizing traditional monarchist values. Concerns about the state religion, as Herr Gubler is expressing, should not hold us back from passing this law - he forgets that the state religion is a symbolic institution, and does not imply that the state and religion are or should be entangled beyond that symbolic dimension. Therefore, the objective of "protecting the state religion" is hardly a valid objection to this reform.
