A BILL to improve awareness of the health risks of smoking and to address the negative effects of smoking to other people than the user;

BE IT ENACTED by Her Imperial and Most Illustrous Luthoran Majesty, Kaiserin Josephine of Hulstria, and His Imperial and Heavenly Majesty, Mikado Okatori Akihiko of Gao-Soto, by and with the advice and consent of the Imperial Diet of Hulstria and Gao-Soto, at Kien assembled, having observed the Constitutional rights of the Länderrat, and by the authority of the same, as follows-
ERLASSEN vom Ihrer Kaiserliche und Erlauchte Luthoranische Majestät, Kaiserin Josephine von Hulsterreich, und Seiner Kaiserliche und Himmlische Majestät, Mikado Okatori Okahiko von Gao-Soto, vom und mit Rat und Zustimmung des Reichstages Hulsterreichs und Gao-Sotos, in Kien versammelt, mit Beobachtung der Verfassungsmäßige Rechten des Länderrates, und auf Autorität des gleichen, wie folgt-

1) Regulations as to the sale of tobacco products
(1) Sale outlets which wish to sell tobacco products shall have to comply with the requirement to get a license for the sale of such products;
(2) Every packet of tobacco sold in stores must prominently display a health warning;
(3) Tobacco products may only be stored behind the counter or in a vending machine; and where such vending machines are placed, they shall be plain except for the logo of the seller or the tobacco company in question.

2) Regulation on smoking in places of employment
(1) It shall be illegal to smoke in places of employment, except those areas excepted under this section;
(2) Places that primarily serve liquor are exempted from the requirement;
(3) Licensed cafés shall be exempted from the requirement;
(4) Areas within buildings that constitute places of employment may be designated for the sole purpose of smoking.

MessageHerr Präsident,

I rise to bring to the House a bill to reduce one of the greater risks to public health and the public purse in our country today: smoking. As the House is well aware, there is ample medical evidence of the harmful effects of smoking tobacco, which include its addictive and carcinogenic effects. I have, for some time, been worried, and many in the medical profession with me, that our rather loose policies on smoking are becoming a risk to public health.

The general argument against such regulations as I propose today is generally that it is the own choice and own responsibility of the smoker - I, too, believe that. However, I see nothing wrong with discouraging people from making that harmful choice by making it more difficult for them to obtain tobacco or to be affected by the flashing lights of misguiding commercials and packaging that do not make mention of tobacco's harmful effects. That is why I propose common-sense regulations on the sale and promotion of tobacco products to keep people, especially amongst the youth, from taking up this unhealthy and potentially disruptive habit.

Herr Präsident, I am also taking another precaution which is also in accordance with the principle outlined above: you can choose to harm yourself, but not others. There is a problem which Frau Lahnsteiger, during her time in my Department, insufficiently realised: the fact that smoking endangers not just the smoker himself, but potentially those around him who breathe the fumes of tobacco. They, too, though to a lesser extent, can be exposed to its harmful effects. If exposure is sufficient, that will lead to health risks not of the choosing of those who fall ill because of it. Especially in places of employment, where people cannot so easily make the choice to avoid smoking colleagues because they are under contract, this exposure can be long-term and therefore potentially dangerous.

I find that an unacceptable, and that is why I propose to ban smoking in all places of employment. Mindful of the special circumstances in some businesses, I have included special dispensation for cafés and those establishments primarily serving liquor, where smoking is part of a rich heritage, to be exempted from this requirement. However, I am calling upon the responsibility of those establishments to consider a non-smoking policy accompanied by a separate smoking room insise the establishment, to help us combat this risk to public health.

I call upon the Diet to help us reduce this risk to our public health and pass this bill.
