Law on the Creation of the Republic. Recent events have highlighted deep problems with the Constitution of the Imperium. Unclear division of power within the executive, special emergency laws that allow endless tyranny, an inefficient High Court, and the lack of democratic accountability have all allowed minority Dundorfian rule to last for centuries, and were responsible for one of the most horrific genocides in Majatran history. The Senate and People of Selucia thus undertake to reform the Selucian government in such a manner as to enhance good governance, rule of law, and democratic rule, and remove the uncertainties plaguing the current Constitution. I. Res Publica 1. The Selucian Republic (Res Publica Seluciana) is established, replacing the Imperium as the legitimate government of Selucia. 2. The Res Publica shall function under the principles of collegiality, equality under the law, democracy, and civilian rule. 3. The sole official language of the Res Publica is the Selucian language. II. Senate 1. The supreme legislative body of the Res Publica is the Senate. 2. The High Court is abolished. The Senate will have full legislative autonomy, and shall also have the right to supervise the actions of the executive and try cases of high treason and crimes against humanity. 3. The office of Princeps Senatus will be restored to its original function, that of Speaker of the Senate. As the representative of the Senate, the Princeps Senatus will no longer have the power to command troops, either during a Special Situation or otherwise. The Princeps Senatus will be the most senior Senator within a legislative session, and his main right shall be that of speaking first during Senatorial debates. 4. The cabinet shall be elected by the Senate and be accountable to it. III. Consuls 1. The principle of collegiality is introduced for the executive magistratures. The office of Imperator is replaced by two Consuls who shall act as collegial heads of state of the Republic. 2. In order to balance the stringencies of direct and representative democracy, one Consul shall be elected by the Senate and the other by the People. Both shall have fully equal rights and responsibilities. 3. Both Consuls shall have equal Imperium, and as such shall act as joint commanders-in-chief of the armed forces. 4. One Consul can veto the actions of the other. The actions of one Consul can be appealed to the other. 5. Consuls are immune from litigation during their term in office, but may be obliged to account for their actions to the Senate after their term. 6. The Consuls shall jointly preside over the cabinet. IV. Emergency Law 1. The Emergency Law is abolished. 2. In case of threat to the Res Publica, the Senate can pass a Senatus Consultum Ultimum establishing a State of Emergency which shall authorize the Consuls to take full command of the armed forces and take whatever actions are required for the preservation of the Res Publica. A Senatus Consultum Ultimum requires at least half of the Senate to vote in favour. 3. Consuls can violate existing laws under a Senatus Consultum Ultimum, but will have to account for their actions once the State of Emergency has ended. If their actions are deemed excessive or against the spirit of the Constitution, they can be tried for high treason. 4. A Consul can veto the others actions even during a State of Emergency. 5. A State of Emergency may not last longer than 4 years, and it may be abolished earlier by vote of half of the Senate. V. Dictator 1. In cases of extreme threat against the Res Publica, the People, or the Senate, a Dictator or Dictatrix is elected by the Senate. 2. The Dictator must be elected by a 2/3 majority in the Senate. 3. The Dictator has imperium maius, overriding that of the Consuls; as such, he or she has full command of the armed and security forces during his or her term in office. 4. The Dictator is not bound by the laws of Selucia during his or her term in office and does not need to account for his or her actions, during and after his or her term in office. 5. The name "Imperium", in spite of its historical relevance, makes little sense as the name of a form of government in the Selucian language, as its primary meaning is that of the authority of military and political leader to command troops.
