§ 1. PURPOSE & POLICY. Finding that there is no adequate method to regulate and adjudicate the congtrolling Laws of Solentia, the SOVEREIGN SENATE hereby finds that a Ministerial Court be hereby established.


§ 2. ADMINISTRATION OF THE COURT. The Court shall be presided over by the Minister of Justice, who shall serve as the Chief Justice of the Ministerial Court.


§ 3. SOLENTIAN CODE OF REGULATIONS. The Minister of Justice shall maintain and update the SOLENTIAN CODE OF REGULATIONS (S.C.R.), the substance of which is provided by the SOVEREIGN SENATE through legislation.

__(a) The SOVEREIGN SENATE shall in every bill include any rules and regulations that it wishes to attach to the Controlling Law by including a section titled "Rules & Regulations" and shall include which Ministry is responsible for its enforcement.
__(b) "Controlling Law" here is defined as an RP or Game Mechanic Law.


§ 4. JURISDICTION. The Court shall have jurisdiction over all claims and causes of action arising under the "Rules & Regulations" provisions of the controlling Law. The Court shall not have jurisdiction over the controlling Law, only the rules and regulations promulgated by Sovereign Senate as provided for in legislation or as expressly delegated to a Ministry by provision within the same law.


§ 5. ADJUDICATION. If a party is in violation of the rules and regulations of a controlling Law, then that party is subject to action in the Ministerial Court. Such proceedings are initiated by the Ministry's charged with enforcing the rule or regulation in question.

__(a) The Ministry upon finding a violation shall file a claim via electronic mail to both the Chief Justice and the Party in Violation, stating both the name of the violating party, the controlling law, the rule and regulation which the party has violated, and a request for remedy as provided under this section.
__(b) The Chief Justice shall determine whether or not the Court has jurisdiction as provided under Section 4 and shall proceed if it is answered in the affirmative.
__(c) The Chief Justice shall hold a hearing and in the title shall name it "MINISTRY v. LAST NAME or COMPANY NAME." In the Description, the Chief Justice shall summarize how the case came before the court.
__(d) The Chief Justice shall SPEAK (OOC: Post) first and shall ask questions, to which the party being questioned shall answer. No party to a case shall speak unless being spoken to.
__(e) After the Chief Justice has given both parties equal opportunity to speak and has arrived at his or her decision, the Chief Justice shall state IN ALL CAPS that a decision has been reached and shall draft a decision and make it the Last Post on the board, and shall post that decision in the Ministerial Court Decisions log.


§ 6. APPEALS. If a party wishes to appeal the decision of the Ministerial Court, they shall appeal to the Supreme Court pursuant to 5. U.S.C. § 1 (Justice) and as provided by Law.

Message"We've consistently backed your supreme court proposals. Why not return the favor? Pass this bill and it will be one step closer to a Supreme Court. 5 U.S.C. Sec. 1 already mandates that we have both national court and a high court, this solves one of those issues.

Why should we continue to let wrongdoers violate regulations and laws without some for of adjudication? Right now, we have neither a high court or a lower court. We are merely asking that a lower court be instated, which will only help the argument for the need for a workable high (supreme) court.

Filibustering does not help your aim for a more concrete and organized judicial system."
