RECOGNISING that the steps undertaken by previous sittings of the Legislature have put human, fiscal and social capital into the development of provision for children and young people who have Autism Spectrum conditions (ASC) or similar Special Educational Needs (SEN),

NOTING that the Special Educational Needs Provision Act 2986 (http://classic.particracy.net/viewbill.php?billid=298901) was renewed with a fresh mandate and set of provisions in the Autism & Special Educational Needs Act 3837 (http://classic.particracy.net/viewbill.php?billid=435213)

This Senate does hereby require;

Article 1 - On Provision for ASC and SEN within the Department of Education and Culture
a) That the Minister for Special Education be restyled Minister for Inclusive Education.
b) That the Minister's rank be revalued as Senior, ranking one level below Cabinet level
c) That the Minister's remit be expanded to include the following from the Department of Education and Culture;
- 1. All provision for building, maintaining, funding and policy for Special Schools
- 2. All provision for care and education of children and young people with an ASC or SEN
- 3. Policy and provision for Behavioural Schools, units and departments across all schools irrspective of their designation as Special or Mainstream

Article 2 - On Provision for Directors of Inclusion
a) That all schools be required to appoint a member of staff with Qualified Teacher Status on pay scale 3 who shall have responsibility for all children with ASC or SEN in school and provisions for their access to the curriculum
b) That this member of staff be known as the Director of Inclusion
c) That the Director of Inclusion's remit shall cover the following;
- 1. Safeguarding concerns and child protection including overseeing of the designated Child Protection Officer
- 2. Provision for children and young people with ASC or SEN and their access to the curriculum
- 3. Inclusion practice for children and young people who have displayed patterns of challenging or complex behaviours
-4. Training of all staff in how to care for and adequately teach children and young people who display complex behaviours and SEN
-5. Line management of all education support staff

Article 3 - On Provision for Educational Support Staff
a) That all schools be required to appoint Educational Support Staff to cater for the needs of children and young people with ASC and SEN in access to the curriculum
b) That this provision may take multiple forms at the discretion of the school in line with provisions made in Article 4.

Article 4 - On Provision for Education, Health and Care Plans
a) Any children or young people who display behaviours that indicate they may have ASC or SEN shall be subject to provision under an Education, Health and Care Plan (EHCP).
b) The details of this plan shall be drawn-up in liaison with multi-party panels of experts including, as a minimum;
- 1. Parents and/or designated legal guardians of the child or young person
- 2. The registered Doctor under whose care the child or young person is legally registered
- 3. The teacher of the child or young person
- 4. Any additional support staff that work with the child or young person in their school life
- 5. Any of the following professionals with whom the child or young person may require regular contact or assessment with; Speech and Language Therapists, Child Psychologists, Paediatricians, Physiotherapists, Mental Health Nurses, Specialist Nursing Professionals,

Article 5 - On the scope of the Act
a) This Act shall consider children and young people to refer to anyone from birth to 25
b) All Solentian citizens from birth to 25 shall be able to get access to support and care via an EHCP

Article 6 - On funding
a) This Act shall assign an additional 100m Solenar to the Schools budget for provision of additional support staff
b) This Act shall assign an additional 100m Solenar to the Health and Social Services budget for the provision of additional administrative costs of the EHCP

Article 7 - Time scale and requirements
a) This Act shall become law with a simple majoirty
b) This Act shall be binding for 5 years and shall be subject to periodic and continued review every 10 years.
