PROPOSAL We propose that capital punishment be introduced in certain circumstances. Murder committed by a re-offender - If a murderer is sentenced to so many years in prison, and upon release murders again and are proved guilty, then they should be executed. Serial Murder - If a murderer murders one or more persons, on multiple occasions, and they are proved guilty, then they should be executed Serial Rape - If a rapists rape one or more persons, on multiple occasions, and they are proved guilty, then they should be executed Child rape - If an adult rapes a minor (someone below the age of adulthood) and they are proved guilty, they are executed. If a Policeman is murdered - and the murderer is proved guilty, then they should be executed. --- REASONING We feel than in the above circumstances capital punishment is necessary. In the first case, it has been proved that the offender is beyond rehabilitation and thus should be executed. In the second case the murderer has proved that they are motivated purely by evil and they should be executed. The third case is the same as the second. The fourth case offers additional protection to children. The fifth case offers protection to police officers, especially those who work in prisons. --- TRIAL Trials for murder cases shall involve a jury of 12 persons, all 12 must agree that the suspect is guilty BEYOND ALL REASONABLE DOUBT. Once this has been proved then the final decision is left up to the judge, about whether or not to apply capital punishment in this case. This keeps the decision firmly in the hands of the judiciary. --- APPEALS A suspect who is pronounced guilty, and condemned to be executed, is given one appeal, that should occur within six months of the first trial. If this appeal is quashed, then execution shall occur within one month. This prevents the system from descending into chaos, with multiple appeals, prolonging the stay on death row for years. The proposed system means that death row will last a maximum of 7 months. --- METHOD The condemned shall be executed by hanging --- INTERVENTION The President has the power to intervene and impose a life sentence upon the condemned man |
