The ISLP, as promised, presents to the parlament a consolidated law to regulate the banking system.
This Consolidated Law is a proposal to introduce measures to regulate the activity of financial speculation by the financial intermediates and to prevent banking panic situation. So those are meausures to prevent the affectation of real economy from financial crisis with the introduction of a National Deposit Guarantee Found and of a financial ring-fencing.
The Deposit Guarantee Found will protect bank depositors, a maximum cap of one hundred LIS (100.000 LIS), from losses caused by a bank's inability to pay its debts when due.
The ring-fencing measure will impose to the commercial Istalian Banking System's member banks a mandatory separation of trading and the rest of the banking business, if the volume of brokerage exceeded 100 billion LIS (100.000.000.000 LIS), or 15-25% of the bank's assets. The separate activities of trading and deposits may coexist in the same bank, but will need to be funded and capitalized separately.
The law foundamentally want separate the exercise of high risk financial activities from the banking base activities.
This measures will ensure:
Protection from the contagion among the most risky activities of investment banking and traditional banking activities of collecting deposits and disbursement of prestit, to avoid that the crisis of an institution or a country can affect other institutions and countries.
Greater financial markets stability.
Strengthening the protection of taxpayers' money, since the resolution of banks in smaller disruption can take place without recourse to public funds.
Reduction of distortions of competition among banks.
