| Arbitrator: The Honourable Chief Justice of the Supreme Court, Jon Robertson. [Conservative Party] Prosecutor: Deputy State Prosecutor, Jason Franks [Patriotic Party] Defendants: Leader of the Revolutionary Anarcho-communist party Karl Benn Charges: Illegal possession of firearms Forming and operating a paramilitary with intent to use force. Jury - All 10 parties in Baltusia will be asked for their verdict. Guilty or Not Guilty. Procedure: 1.) The Prosecutor will put forth his evidence for the arbitrator to review. 1.5) The Defendant will have an opportunity to plead guilty. 2.) The Prosecutor will make his case. 2.) The Defendant will have to opportunity to scrutinize the case of the Prosecutor. 3.) The Prosecutor will have an opportunity to respond to the scrutiny of his case. 4.) This shall repeat until the Prosecutor rests his case. 5.) The arbitrator shall oversee the case, but the decision of guilt is to be decided by the Jury when the arbitrator declares, the jury shall convene and vote. 6.) They may decide that the defendant is guilty and which point the arbitrator will pass sentence. They may decide in favour of innocence, in which case the defendants are to be released. | Message | Thank you, Your Honour. May I start by reminding members of the jury regarding the pertinent areas of the law: Paramilitaries are illegal and the recognized government may intervene freely to stop any possible activity. People must first obtain a permit in order to carry concealed weapons. Please remember those two laws as we proceed because I say that the defendant is in breach of both and therefore must be found guilty of the crimes of which he is accused. I refer first to Exhibit A. Here the court can clearly see that Mr Benn in his position as leader of the Revolutionary Anarcho-communist party (I shall use RAC as abbreviation from now on) set up the Revolutionary Guard. He says the body is there to protect people and fight for their rights. There are clear pictures of some of the body's troops - including militia, regular guardsmen and anti-terror teams. You will see from his own images that many are armed to the teeth with guns, rifles and grenades. Others with riot weaponry and shields and wearing body armour. He also claims that they are"fight small battles already". Exhibit B shows how big the organisation has grown. In his own words Mr Benn says "100s of 1000s of people across Baltusia have joined to protect themselves'. He says, again, the guard are "committed to fighting to protect the common people." In Exhibit B he is asked to stand down the organisation by the then defence secretary - he refuses. The defendant goes on to explain how he will use the Revolutionary Guard to fight another organisation - namely KrugerSec - In exhibit C and D. This of course is the role of the police, not Mr Benn, the RAC or his paramilitary. He says "the revolutionary guard will stop it" and it a particularly provocative outburst he says: "The Revolutionary Peoples Guard has been called in to stop the invasion by the Conservatives and KrugerSec". Members of the jury, look at the evidence in front of you - this clearly an illegal paramilitary organisation - armed to the teeth with illegal weapons they have no permits for, waging war and pitched battles in our nation. Mr Benn set this organisation up and actively encourages it to fight even when asked to back down. He is remorseless and not given to reason when told of his crimes. Finally, if you still believe that Mr Benn has peaceful intentions I direct you to Exhibit E. He signed up his party to an organisation called The Partisan's Rifle. In their own words they"support the action of revolution, that of both political and violent. As partisans' we shall conquer cities, the Red-Flag forever flying..." This proves beyond doubt that the defendant is of a mind to turn to violence - when necessary - to achieve his ends. The state asserts he is a deeply violent individual who will use illegal armed forces wherever he deems fit and should be found guilty on both charges. It appears that the more suitable charge for Mr Benn's firearms offences would be: ~Illegal Possession of firearms with intent to endanger life or injure property. rather than the current ~Illegal possession of firearms If the prosecution decide to press the new charges it shall be the jury decision, however if left with the original charge then I shall decide the verdict. He now has a chance to plead that the evidence has been laid out and a charge has been changed. Mr Benn, unfortunately I'm not buying your case- You must be the leader of The People's Guard, you are the leader of the RAC Party, who founded the People's Guard.You appear to be the only leader. Even if you were only a communal member, you directed and informed Baltusia of your battles and breakdown of the paramilitary. Is there a different leader Mr Benn or are you the general communal leader?
