We don't believe there should be a cap on monetary damages awarded to patients in lawsuits, we firmly believe that every lawsuit should be treated on a case by case basis, not a blanket cap. It could possibly hinder justice.

This bill will prevent taking all the wealth that the accused has accumulated. Sometimes the victim will hurt himself just to get the money. Maintaining a cap would actually uphold the justice. We propose a symbolic cap of 2,500,000 DDO.

What if however someone has done such a heinous act to the accuser, something which they feel 2,500,000 DDO will not cover? What if the accused has made damages which only 3,000,000 DDO will fix? As stated, we believe things should be taken on a case by case basis, in extraordinary cases, we don't believe there should be a cap on justice.

Did you saw that I said "propose" ? Also, how money would fix for ex. brain damage ? Money is not a repair tool. A person with brain damage should want money only for recovery (and medical expenses), not for a new house. I guess you wouldn't want losing all your money, just because somebody wanted to have it. Our new proposal for monetary cap: 5,000,000 DDO.

Money could help pay for equipment and tools needed to help the proposed person with brain damage. Also, fining the accused for money will serve as a punishment, not just for the accuser's benefit.

The equipment and tools are considered as medical expenses too. Also, did you thought about cooruption in our country ? What if a judge will sentence you to pay for ex. 30,000,000 DDO and will take a part from it ?

At least there will be a small plus: the accused won't be left on the street without a cent to live. A cap will prevent from taking all the funds from someone. My party wants to establish a monetary cap and a percent cap (probably around 85-90%).

A reasonable judge wouldn't allow that to happen regardless of a cap, unless they felt it a worthy punishment. Something else to take into account, what if the accused is fabulously wealthy? 5,000,000 DDO may not make much of a difference to them, another reason a "one size fits all" regulation will not work!
