| THE PRESIDENTE DELLA REPUBBLICA The Presidente della Repubblica shall be the Head of State of the Repubblica Istaliana (Istalia). He shall represent the Nation, guarantee its independence, the respect of the International Treaties and see to it that this Constitution is observed. He shall be the holder of Executive Power with the Government, the Head of the istalian Armed Forces, the Highest Office in the Judiciary. The Presidente della Repubblica is elected directly by the eligible voters with a two roud absolute majority system is the only that have the right and responsibility to propose a Government Cabinet. He appoints and dismisses the Presidente del Consiglio dei Ministri. He appoints and dismisses members of the Government upon a proposal by the Presidente del Consiglio dei Ministri. He chairs the Council of Ministers. He can dissolve the parliament, he has to consult the Presidente del Consiglio dei Ministri and the President of the Camera dei Deputati, this when an election did not express a majority in the Camera dei Deputati and have been found impossible to form one which can ensure the confidence to a Government. He shall direct the Nation's Foreign Policy in cooperation with the Government, is the Head of Diplomacy and receives Foreign Ambassadors. He shall promulgate the Laws approved by the Parliament. He have the right of veto: he can ask the Constitutional Council a further check on the constitutionality of a law before its promulgation. He index referendum proposed by the Government or by a motion of the Camera dei Deputati. He has initiative on the revision of the Constitution on the proposal of Presidente del Consiglio dei Ministri. He may assumed full powers and may legislate by decree in case of national emergency, in this exceptional situation, however, the Parliament is automatically convoked and may not be dissolved under any circumstances. He may send messages to the Camera dei Deputati. He may grant pardons, not amnesty. The Presidente della Repubblica may be impeached by the Camera dei Deputati only on the basis of the charges of high treason or violation of the Constitution and the vote of impeachment requires 2/3th of the Camera dei Deputati vote in favor. In case of death, permanent disability, resignation or removal from office, the Presidente della Repubblica shall temporary fulfilled by the Presidente del Consiglio dei Ministri that exercise the function of Presidente ad Interim della Repubblica (Acting President of the Republic) which have no right to dissolve the Parliament, appoint referendum, and also provisons of the Constitution and shall call early election and lead the Government until the vote. THE CONSIGLIO DEI MINISTRI The Consiglio dei Ministri (Cabinet) is the Government of the Republic and is composed by the Presidente del Consiglio dei Ministri, by the Ministers of the Repubblic, by the Delegates Ministers under the authority of one of the Ministers or of the Presidente del Consiglio dei Ministri which has delegated certain powersand, by the Secretaries of State. It shall conducts the policy of the Nation, it aid and advise the Presidente della Repubblica and disposes of the Administration and the Armed Force. All the government initiative Laws and the Presidental Decrees have to be approved by the Consiglio dei Ministri. The Government is responsable to the Camera dei Deputati and shall have its confiance after the appointment by the Presidente della Repubblica. The Camera dei Deputati may remove the Government from office with a vote of no confidence. The Presidente del Consiglio dei Ministri is the Head of Government and of the Consiglio dei Ministri. He shall direct the actions of the Government. He is responsible for National Defense. He ensures the enforcement of laws. He exercises regulatory power and appoints civilian and military. He is the Head of State Administration. * * * * * * * * * * * * * This is a Constitutional Law and to pass needs that 2/3th of the Parliament vote in favor. If the Law will pass its provisions will be applied to the elections next this vote.
