IMPERIAL CONSTITUTION OF MIKUNI-HULSTRIA

Article I) Of the State of Mikuni-Hulstria
(1) Mikuni-Hulstria is a state grounded in its Imperial tradition and liberal, democratic, Septembrist values; it shall be a Rechtsstaat; (OOC: German term denoting the rule of law)
(2) Sovereignty belongs to the Imperial person on behalf of the people;
(3) the territory belonging to the Crownland of Harusutoria, the Crownland of Byudenra, the Crownland of Hiruga, the Crownland of Kurasa and the Crownland and Free State of Mitorania comprises the territory of the state, indivisible and inseparable;
(4) Imperial Citizenship belongs to all citizens of the Crownlands;

Article II) Of the Rights of Citizens and Inhabitants
(Not going to write all this up, presume it enumerates the standard rights)

Article III) Of the Imperial Sovereignty and the Governor-General
(1) the Imperial sovereignty belongs to the Imperial person of the Tenno-Kaiser Yukio-Rabuzubagu Yukio-no-Mikoto II of the regnal name Jihibukai and his heirs and successors, according to the law;
(2) the Imperial person shall symbolize the unity of the nation and its values;
(3) the Imperial person shall be assisted in his duties and represented by an elected Governor-General and Reichsschogun, elected to a term of like length to the Imperial Diet;
(4) the Imperial person is inviolable: political responsibility belongs to the Governor-General and His Imperial Majesty's Ministers;
(5) the Imperial person shall, in addition to the traditional oaths of office and oaths to the state religion, swear an oath to the unity of the Crownlands, and he shall swear to exercise his monarchical power in the interests of all of its peoples, Hulstro-Showan, Hulstrian and Kunihito;
(6) the Imperial person shall create nobles and award knightly orders on his personal initiative and on the advice of the Imperial Diet, the State Chancellor, the Governor-General or the governments of the Crownlands, for services to the nation;
Article IV) Of the Political Process

(1) Political parties shall participate in the formation of the political will of the people. They may be freely established. Their internal organisation must conform to democratic principles. They must publicly account for their assets and for the sources and use of their funds.
(2) Parties that, by reason of their aims or the behaviour of their adherents, seek to undermine or abolish the free democratic basic order or to endanger the existence of the state shall be unconstitutional. The Imperial Constitutional Court shall rule on the question of unconstitutionality.

Article V) Of the Imperial Assembly
(1) legislative power is vested in the representatives of the Estates in Ranzurado, and of the Crownlands and peoples of Mikuni-Hulstria in Reichstag, assembled in the bicameral Imperial Assembly;
(2) the Reichstag shall consist of the representatives of the people elected under the law by universal suffrage; it shall sit for 47 months or until it stands dissolved by the Imperial person upon the advice of a majority resolution of its members;
(3) the Ranzurado shall consist of the Lords of the Great Houses, the peers created and recognized by the Imperial sovereignty, representatives of the various faiths, as well as delegates of the Crownland governments and of the Mayors of free Imperial cities, as under the law established; it shall have the right to return to the Reichstag with objection any bill for reconsideration;
(4) the right of initiative belongs to the Reichstag;
(5) the right to set the Imperial budget belongs to the Reichstag;

Article VI) Of His Imperial Majesty’s Government
(1) Executive and governmental power shall be exercised on behalf of the Imperial person by His government;
(2) the Imperial person shall appoint, having heard the conclusions of the Governor-General arising out of his consultations with the Diet, from among the members of the Reichstag as State Chancellor to preside over the government the person who is best able to obtain the confidence of and enjoy fruitful cooperation with the Imperial Diet;
(3) the Imperial person shall appoint, with the advice and consent of the State Chancellor, Ministers and State Secretaries to serve in His government;
(4) His Imperial Majesty’s Government shall be assisted in the administration and execution of their duties by a Civil Service based on the principles of merit and political independence;
(5) His Imperial Majesty’s Government and any of its members shall serve solely while they enjoy the confidence of the Imperial Diet; they shall tender their immediate resignation to the Imperial person where a loss of such confidence is certified;

Article VII) Of the judiciary
(1) The judiciary shall be independent; judges shall serve for life;
(2) There shall be a system of courts established by law;
(3) The Imperial Constitutional Court (Raikusubafasungsgerigutu) shall be the highest instance of appeal;
(4) All citizens have the right of appeal and of representation in court.

Article VIII) Of the governments of the Crownlands
(1) The Constitution guarantees the autonomy of the Crownlands and, where applicable, their Cantons and Gemeinden;
(2) The Crownlands shall be autonomous in such matters as the law shall describe; their constitutions shall not contradict the provisions of this Imperial Constitution; the law may make further provisions concerning their institutions;
(3) The legislative powers of the Crownlands shall be vested in a legislative body referred to for the purposes of national law as the Randotagu (Landtag);
(4) The Imperial sovereignty shall be represented in each Crownland by a Raikusukomisaru (Reichskommissar, Imperial Commissioner) appointed by the Imperial person upon the advice of the Governor-General;
(5) The Raikusukomisaru shall appoint based on the confidence of the Randotagu for each Crownland a government consisting of a head of government referred to for the purposes of national law as a Minister-President and Crownland Ministers;
(6) Each Crownland shall for the adjudication of its laws refer to the system of courts established under the law;

Article IX) Of amendments to this Constitution
(1) The Imperial Constitution may be amended by a two-thirds majority of the Imperial Diet with the concurrence of the Ranzurado;
(2) Such amendments may be proposed by members of either House of the Imperial Assembly or the governments of two Crownlands.

MessageOOC: I like it and would vote for this. One thing I would like to see added is a little bit of the Three Departments and Six Ministries system (http://particracy.wikia.com/wiki/User_blog:Reno_Vercetti/Design_of_a_Gao-Showan_Federal_Monarchic_System) - not the whole shebang, but just restructuring of the names and functions of the IG ministries to match the Six Ministries system of Imperial China or Joseon Korea. I think this system would work nicely with a democratic political structure - it's more a cosmetic change regarding terminology anyway.

So under the State Chancellor (HoG) we could have the below ministries:

Ministry of Personnel (Internal Affairs)
Ministry of Revenue (Finance), with Food and Agriculture under its authority
Ministry of Rites (Education and Culture), with Foreign Affairs, Environment and Tourism, and Health and Social Services under its authority
Ministry of Defence (Defence)
Ministry of Justice (Justice)
Ministry of Public Works (Infrastructure and Transport), with Science and Technology and Trade and Industry under its authority.

This would be merely a cosmetic change (since we can't change who can, e.g., draft treaties, since that's hardcoded in the game system) but would open a few interesting RP possibilities. I also feel that combining this system with the Germanic terminology for the rest of the political structure would make for a good Asian-German blend.

MessageOOC: Sorry for the late reply.

One thing that worries me about that system is that it works well with a small number of parties but occasionally in H&GS we had multi-party coalitions. Having a lot of ministerial posts (even more than the hardcoded ones) seems preferable to me because when you create profiles for all of them, I find it enriches the RP.

I'd also say some of the titles you gave don't exactly give a very good job description. For example, Internal Affairs is also responsible for local government, that doesn't seem like "Personnel". I'd prefer if we simply renamed a few of the regular departments and perhaps added new ones. So Infrastructure and Transport could become Public Works, Finance could become Revenue (or perhaps "Ministry of the Imperial Treasury" or whatever). Something like that.

MessageIC: It should be read as "liberal democracy", which is not so much ideological as a particular configuration of the state. We acknowledge the objections regarding mention of Septembrist values and while we believe these values are implicit in the present draft anyway, we respect its removal from the final text.
