Preamble:- Recognizing that our increased involvement in international affairs has gained us attention which is not of the most "friendly" sort, this legislation calls into to action, the creation of a government agency that will protect the internal interests of the nation. Article 1: The General Directorate for State Security (a) There shall be a security agency called the General Directorate for State Security. (b) The General Directorate for State Security shall be under the authority of the Minister of Internal Affairs and the respective Ministry of Internal Affairs. Article 2: Functions of the General Directorate for State Security The functions of the General Directorate for State Security:- (a) To act in support of the actions/activities of the Imperial Police Service, the Institute for Strategic Solutions and other law enforcement agencies in the prevention, detection and solving of serious crimes. (b) To protect/maintain the integrity of the nation's economic prosperity against threats from external forces (c) To safeguard the nation against acts of terrorism, espionage and sabotage from external forces and from activities which have been seen as a direct threat to the well-being of democracy within the nation. Article 3: The Director-General The everyday operations of the General Directorate for State Security shall be overseen by a Director-General who is appointed by the Minister of Internal Affairs. His/Her functions are as follows:- (a) Ensure the efficiency and effectiveness of the General Directorate for State Security in completing its aims and functions. (b) Ensure that the identities of the operatives of the General Intelligence Service, the General Directorate for State Security and other intelligence organizations/units are kept a secret. (c) Facilitate the storage of secretive government information which is not reasonable for disclosure. (d) The General Director of State Security shall compile a report on the efficiency and effectiveness of the General Directorate for State Security including its given/set aims and function to the Minister of Internal Affairs. Article 4: The Institute for Strategic Solutions and Government Communications Agency The General Directorate for State Security shall work hand-in-hand with the Government Communications Agency and the The Institute for Strategic Solutions in increasing the effectiveness of the General Directorate for State Security in order to complete its set/given aims and functions. With this the General Directorate for State Security will be allowed to:- (a) Intercept the communications of individuals both outside and inside of the Holy Luthori Empire who are seen as a either a threat to national security or the internal and external interests of the Holy Luthori Empire and its government via the interception of their calls. (b) gather intelligence on an individual(s) activities especially when he/she is involved in gang-related activity. (c) gather intelligence on external intelligence agencies operating within Luthori, as well as gather intelligence as to the intentions of known terrorists, spies and saboteurs residing in Luthori and rendering them inactive (through any means). Article 5: Hiring of Staff The hiring of staff of the General Directorate for State Security is supervised by the Ministry of Internal Affairs, through the Immigration and Naturalization Office. Hiring of staff to the General Directorate for State Security is strictly to Luthorian nationals. The General Directorate for State Security will NOT hire nationals from foreign nations. On the passing of this legislation the General Directorate for State Security shall come into immediate effect. This legislation can be amended and/or abolished with a 2/3 majority by the Imperial Diet ===================================================================================================================================================================== Preamble:- As it has come to times in the world when hostility between nations are at its peek, as alliances are formed and as coalitions are destroyed. Now is the time for the formation of our own Intelligence Service. Article 1: General Intelligence Service There shall be an Intelligence gathering service called the General Intelligence Service and its aims and functions shall be as follows:- (a) to obtain intelligence and information on the intentions of individuals outside and inside the Holy Luthori Empire who are seen as a either a threat to national security or the internal and external interests of the Holy Luthori Empire and its government. (b) to perform other tasks and objectives relating to the gathering of intelligence and information. (c) the General Intelligence Service shall be under the authority of the Minister of Foreign Affairs and the respective Ministry of Foreign Affairs Article 2: Functions of the General Intelligence Service The functions of the General Intelligence Service are as follows:- (a) Reinforce the prevention and detection of threats to national security (b) guard the interests in terms of defence and foreign policy of the government. (c) obtain intelligence and information on the intentions of individuals outside and inside the Holy Luthori Empire who are seen as a either a threat to national security or the internal and external interests of the Holy Luthori Empire and its government. Article 3: The Director of the General Intelligence Service The everyday operations of the General Intelligence Service shall be overseen by a Director who is appointed by the Prime Minister. His/Her functions are as follows:- (a) Ensure the efficiency and effectiveness of the General Intelligence Service in completing its aims and functions. (b) Ensure that the identities of the operatives of the General Intelligence Service are kept a secret. (c) Facilitate the storage of secretive government information which is not reasonable for disclosure. (d) The Director of the General Intelligence Service shall compile a report on the efficiency and effectiveness of the General Intelligence Service to Prime Minister. Article 4: The Government Communications Agency The General Intelligence Service shall work hand-in-hand with the Government Communications Agency in increasing its effectiveness in order to complete its set/given aims and functions. With this the General Intelligence Service will be allowed to:- (a) Intercept the communications of individuals outside of the Holy Luthori Empire who are seen as a either a threat to national security or the internal and external interests of the Holy Luthori Empire and its government via the interception of their calls. (b) Conduct Electronic Warfare with given targets and/or infrastructure in order to complete its set/given aims and functions (c) The General Intelligence Service shall use any means necessary of extracting information from individuals. Article 5: Exemption from Prosecution (Immunity) In order to ensure that the efficiency of the General Intelligence Service is kept at high standards, under an Imperial Pardon, all members of the General Intelligence Service are exempted from Prosecution by the Judicial System for any and all crimes, might it be those against humanity and/or war crimes. Article 6: Hiring of Staff The hiring of staff of the General Intelligence Service is supervised jointly by the Ministry of Defence and the Ministry of Foreign Affairs. Hiring of staff to the General Intelligence Service is strictly to Luthorian nationals. The General Intelligence Service will NOT hire nationals from foreign nations. On the passing of this legislation the General Intelligence Service shall come into immediate effect. This legislation can be amended and/or abolished with a 2/3 majority by the Imperial Diet. |

Message | Mr. Speaker, We note that the bill refers to the "Institute for Strategic Services" in Article 2 but refers to another agency called the "Institute for Strategic Solutions" in Article 4. Is this a simple mistake or are these two separate agencies? We also note that there appears to be two "Article 5"s in the second part of the bill. What is concerning to us is the immunity clause. Luthori's national security is important, but so is our reputation in the world. We cannot continue to keep our head high if we harbor war criminals. Does this provision protect against warrants by the International Court of Justice, if it is created by the Security Council? How can the New Conservative Party assure that this will not be seen negatively by many countries that might be involved with intelligence gathering or other such activities? And on one last note, I ask whether the New Conservative Party intends to propose legislation to codify the name changes of certain ministries? I assume that the Ministry of Home and Kingdom Affairs is the Ministry of Internal Affairs? I yield. Rt Hon. Message | Mr. Speaker, The errors have been rectified, We thank United Luthori for pointing out said errors. With respect to immunity. The legislation only allows for immunity against prosecution within our judicial system. The International Court of Justice under a tribunal can sentence someone for war crimes (if he/she is a caught in the act). That is why it is imperative that the identities and actions of the General Intelligence Service are kept secret. We have changed the unnecessary and unexpected wording of the legislation. I yield. Message | In the Luthorian Revolutionary Party, we think there should be, apart from those institutions, another institution that ensures that corruption will not be a problem in our new security system.
