An appropriate monetary cap is difficult to establish. Consider a situation in which a victim is permanently disfigured or disabled as a result of an incident in which another party is completely responsible. Can we put a price on this victim's life and its diminished value?

Our party also raises the argument that if medical expenses reach exorbitantly high amounts, a cap on monetary damages awarded may still leave the victim with a large out-of-pocket cost for a situation in which they were hurt at the hands of another.
