The Democratic People's Movement believes that Baltusians need clearly defined rights so that it is clear when the government is acting outside of its authority. In addition, this Declaration of Rights will provide a clear basis for judicial decisions in areas where there is no existing statute law.

Article 1- All Baltusians shall be guaranteed the right to life.

Article 2- All Baltusians shall be protected from torture, slavery and inhuman treatment.

Article 3- All Baltusians shall be entitled to liberty and security.

Article 4- All Baltusians shall be granted a fair trial and freedom from arbitrary arrest or imprisonment.

Article 5- All Baltusians shall be given privacy in their private and family life.

Article 6- All Baltusians shall have their freedom of thought, conscience, expression and religion protected.

Article 7- All Baltusians shall have their freedom of association and assembly protected.

Article 8- All Baltusians shall have their rights protected equally and fairly.

Article 9- A Baltusian Court of Rights shall be established, with the power to issue a 'statement of incompatibility' when legislation contradicts the rights outlined within the Declaration of Rights. In these circumstances, Congress should consider repealing or amending the specific legislation however they are not obliged to.

Article 10- Every party in Congress shall be entitled to appoint a judge to the Baltusian Court of Rights, with the Justice Minister appointing one further judge. In cases where there is a tie on the Court, the President shall be granted the deciding vote.

Article 11- As a constitutional amendment, this bill requires a two-thirds majority to be passed but may be overturned by a simple majority. However, specific legislation repealing this bill is required in order to remove its provisions from effect; simply passing legislation which contravenes this bill does not represent a repeal of it.

Does Article 1 "All Baltusians shall be guaranteed the right to life" protect unborn babies from being aborted? Furthermore, will it sound the death knell on the death penalty as a judicial sentence?

MessageWe believe that the response thus far suggests that a 'Baltusian Court of Rights' may be necessary. Exactly how this would operate is a matter for debate. The Democratic People's Movement recommends a body appointed politically (perhaps proportionally to Congress) and that has the power to issue a 'statement of contradiction'. In essence, this means that particular legislation is incompatible with the first eight articles of this bill. In those circumstances, it is up to Congress to decide whether the legislation should be repealed.

OOC: This would allow us to have a 'supreme court' without having it breach game mechanics. It's somewhat based on the Human Rights Act in Britain. Unlike the US, courts can't overturn legislation so the decision is left to Parliament- this is much like how the Particracy game mechanics necessitate we must act.

The Centrist party has a few problems with it,

Article 1 is vague, if it does mean that abortion would be outlawed then we do not support it.

Article 3 is also very vague.



For article 5 what if police have search warrants, does that mean they are still entitled to there private life.

Article 8 is also very vague
