Preamble:- Recognizing the need to reinforce our counter-intelligence actions as it is clear that the integrity of this nation has been breached by external clandestine forces. This legislations proposes the introduction of a law to mandate the prosecution as well as baring the efforts of external forces from compromising the intellectual integrity of this nation and the highly secretive documents which it holds.

Section 1: Prosecution for Espionage
(a) Any person (man, woman and/or child) of any occupation who assists in the advancement of the operational effectiveness of foreign agents through the exchange of lucrative information of any sort, that is deemed beneficial to foreign agents at the expense of the integrity of this nation shall be guilty of Espionage.
(b) Any person (man, woman and/or child) of any occupation, who approaches and/or is approached by foreign agents and are requested/told/ordered to conduct espionage against the state, might it be political or economic shall be guilty of Espionage.
(c) Persons upholding the characteristics as stated in Section 1 (A) and (B), shall be sentenced to imprisonment for a period no longer than twenty years and is able to appeal his/her ruling in the Supreme Court.

Section 2: Prosecution for Harbouring Foreign Espionage Agents
(a) Any person (man, woman and/or child) of any occupation who either intentionally or unintentionally harbours a foreign agent of espionage or directly or indirectly meets with said foreign agent on the grounds of information exchange, collection or mission execution shall be guilty of harbouring an Agent of Espionage.
(b) Under the Corruption Conviction Act of 4208 (http://bit.ly/2qRKx75), if said harbour holds an office within government, he/she is to be removed from said office, barred from ever retaking said office and imprisoned for a period of no more than five years.

Section 3: Approval of Prosecution
(a) In order for prosecution in accordance with this legislation to go about, it must be done with the permission/approval of the Prosecutor General.
(b) Prosecutions made without the permission/approval of the Prosecutor General shall be nullified with immediate effect and the person being prosecuted; released.

Section 4: Search Warrant Approval
(a) If a Municipal Judge sees that evidence showing the reason behind the request for a search warrant is factual in every which way, he/she may grant the search warrant authorizing any law enforcement agency, to enter the premises of the individual of question and document/seize/sketch/examine objects which he may find on the premises or place or on any such person, and with regard to or in connection with which he has reasonable ground for suspecting that an offence under this Act has been or is about to be committed.
(b) If any law enforcement agency is to enter an individual's home, even though he/she has broken the various offenses listed in this legislation, the law enforcement agency must leave and any objects/materials seized be returned with immediate effect. As well as individuals detained/arrested be released with immediate effect.

Upon completion of vote, this legislation shall be forced into immediate effect and shall be used as the counter-intelligence apparatus of the Internal Security Directorate

**This act requires a 2/3 majority vote to the passed and in a similar fashion would require a 2/3 majority vote to either be abolished or amended.

MessageChildren? Espionage? Are you sure that makes sense? Children are innocent - they were talked/bribed into doing it unknowingly. I refuse to vote for this bill if you take such an approach to the children of Trigunia.

Not all children are innocent. A person can be bribed (which means that you are willing doing the act for money or advances) or talked into doing something and under judicial law can be charged with accomplice. For example, in a bank robbery, the robber could call a taxi driver (whom unknowingly has no idea that his passengers recently robbed a bank), nevertheless the driver will be arrested as an accomplice to the criminal acts, due to the fact that he actively participated in the criminal act as the robbers' quasi get-away driver. In a similar manner, a child can be arrest for similar acts. In the case of this act, a child who actively participates in matters of espionage, will be charged as being an accomplice to the acts and well as conduct espionage and/or sabotage against the State. In the legislation it outlines,

"Any person (man, woman and/or child) of any occupation, who approaches and/or is approached by foreign agents and are requested/told/ordered to conduct espionage against the state, might it be political or economic shall be guilty of Espionage"

This is similar to being charged as an accomplice, if said person(s) execute the request willing-ling and/or unwillingly, will be charged as an accomplice to the actions and as a result will be charged with Espionage the state if these actions prove to be directly aimed against the institutions of the state.

I would excuse Mr. Nikitin's comment for he did not spend twenty-five years in the intelligence service, so i expected his opinion on the matter to be single minded and i believe that the opinion of the SDP is similar to that of the KDP, single-minded with no intelligence or thought-process to reinforce it.
